24.17.090 Sewage technologies.

(1)    The department shall maintain standards and guidance for local health officers to permit sewage treatment and distribution technologies.

(2)    Before the local health officer permits sewage technologies, the sewage technologies must be registered for use as described in this chapter, have standards for use as described or referenced in this chapter, or have DS&G describing sewage technologies uses as maintained by the department.

(3)    The department may remove, restrict, or suspend a proprietary product’s approval for use based on failure to meet required standards or conditions of approval or if the information provided by the manufacturer is false, erroneous, or unrepresentative of the approved product.

(4)    CCPH adopts as guidance all DOH DS&Gs, both current and any future revisions. Every attempt will be made to apply these standards and guidance to system application; design; installation; operation, monitoring and maintenance; performance expectations; and sources of information.

(a)    CCPH may grant variances from DS&Gs when the DS&Gs cannot be adapted to local conditions or where the proposed variance appears to meet or exceed the intent of the DS&G and where no negative public health impacts are expected.

(b)    An explanation of the rationale for such a variance will be documented in the CCPH record.

(5)    CCPH shall not issue product development permits (PDP); only the State Board of Health may issue such permits. (Sec. 10 of Ord. 2007-10-01; amended by Sec. 8 of Ord. 2025-03-12)
