9.02.010 Adopted.

(1) That a certain document, one copy of which is on file in the office of the city clerk of the city of Clarkston, being marked and designated as the International Fire Code, 2006 Edition, including Appendix Chapters A through G, as published by the International Code Council, be and is hereby adopted as the fire code of the city of Clarkston, Washington, for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials, and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said fire code on file in the office of the city of Clarkston are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in subsection (2) of this section.

(2) The following sections are hereby revised:

(a) Section 101.1. Insert: “City of Clarkston.”

(b) Section 109.3. Insert: “penalties as provided in Section 9.02.060 of this chapter.”

(c) Section 111.4. Insert: “not less than $100.00 nor more than $1,000.00.” [Ord. 1443 § 1, 2008.]

9.02.020 Establishment of duties of fire department.

(1) The International Fire Code shall be enforced by the fire department of the city, which is established and which shall be operated under the supervision of the fire chief.

(2) The fire chief of the city fire department may detail such members of the fire department as inspectors as may from time to time be necessary. The fire chief shall recommend to the city council the employment of technical inspectors who, when such authorization is made, shall be selected through an examination to determine their fitness for the position, all in accordance with the civil service rules of the state of Washington. 9.02.030 Definitions.

Whenever the word “jurisdiction” is used in the International Fire Code, it is taken to mean the city of Clarkston, county of Asotin, state of Washington. [Ord. 1443 § 1, 2008.]

9.02.040 Establishment of limits.

The geographic limits referred to in certain sections of the 2006 International Fire Code are hereby established as follows:

(1) Section 3204.3.1.1: Location. The limits referred to in Section 3204.3.1.1 of the International Fire Code in which location of stationary containers of cryogenic fluids is restricted is established as follows: Stationary containers shall be located in accordance with Section 3203.6. Containers of cryogenic fluids shall not be located within diked areas containing other hazardous material. Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited except within the zone designated as heavy industrial by CMC Title 17.

(2) Section 3404.2.9.5.1: Locations where aboveground tanks are prohibited. The limits referred to in Section 3404.2.9.5.1 of the International Fire Code in which storage of Class I and II liquids in aboveground tanks outside of buildings is restricted are as follows: Storage of Class I and II liquids in aboveground tanks is prohibited except within the zone designated as heavy industrial by CMC Title 17.

(3) Section 3406.2.4.4: Locations where aboveground tanks are prohibited. The limits referred to in Section 3406.2.4.4 of the International Fire Code in which storage of Class I and II liquids in aboveground tanks is restricted are as follows: The storage of Class I and II liquids in aboveground tanks is prohibited except within the zone designated as heavy industrial in CMC Title 17.

(4) Section 3804.2: Maximum capacity within established limits. The limits referred to in Section 3804.2 of the International Fire Code in which storage of liquefied petroleum gas is restricted are established as follows: The storage of liquefied petroleum for the protection of heavily populated areas shall be restricted to the zone designated as heavy industrial in CMC Title 17. 9.02.050 New materials, procedures or occupancies.

The fire chief and building inspector shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, procedures or occupancies for which permits are required in addition to those now enumerated in said code. The fire chief shall post such a list at a conspicuous place in his office and distribute copies thereof to interested persons. [Ord. 1443 § 1, 2008.]

9.02.060 Penalties.

(1) Any person who shall violate any provisions of this code or standards adopted, or fail to comply therewith, or who shall violate or fail to comply with any order thereunder or any certificate or permit issued thereunder and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the city council or by a court of competent jurisdiction within the time fixed herein, shall severally and for each such violation or noncompliance, respectively, be guilty of a misdemeanor punishable by a fine of not more than $250.00 or by imprisonment for not less than 30 days or both. Imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. When not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense.

(2) The application of the above penalties shall not be held to prevent the enforced removal of the prohibited condition. [Ord. 1443 § 1, 2008.]
