PARKS AND RECREATIONAL FACILITIES--EJECTION

12.22.010 Misconduct--Ejection.

Any person or persons using the city parks and recreational facilities (herein "parks" or "facilities") shall be ejected from and denied the use of said facilities for misconduct consisting of any of the following:

A.  Intentional disruption of any peaceful, lawful assembly of any other persons or group using the facility;

B.  Intentional obstruction of vehicular or pedestrian traffic of others lawfully using the facility;

C.  Making loud and disruptive noise by voice, instrument or device which disturbs other persons of normal sensibilities from the peaceful enjoyment of the facilities or the peaceable enjoyment of the surrounding community;

D.  Intentionally or maliciously annoying or molesting others lawfully using the facility;

E.  Refusing to comply with the lawful order of a police officer to disburse if part of a group or gathering which the officer reasonably believes by behavior and conduct is threatening an imminent breach of the peace;

F.  Engaging in a fight, brawl, or riotous conduct dangerous to life, limb, health or property of others while using the facility;

G.  Intentionally damaging or degrading public property or equipment.  (Ord. 1501 §1, 2002; Ord. 1500 §1, 2002).

12.22.020 Notice of ejection.

Any person violating this chapter shall be issued a notice of ejection subjecting the person to immediate loss of use of the city parks and facilities.  (Ord. 1500 §2, 2002).

12.22.030 Notice of ejection--Appearance before court.

The notice of ejection shall provide for a mandatory appearance before the city municipal court.  (Ord. 1500 §3, 2002).

12.22.040 Notice of ejection--Person under eighteen years.

A copy of the notice of ejection issued to a person under the age of eighteen years shall be served upon that person’s parent or guardian. (Ord. 1500 §4, 2002).

12.22.050 Violation--Penalty.

Following a hearing on the notice of ejection and a finding of a violation hereof, the court may impose a no-trespass order prohibiting the person the use of the city parks and recreational facilities in accordance with the following schedule:

A.  Upon the first violation within a twelve-month period, a thirty-day no-trespass order;

B.  Upon the second violation within a twelve-month period, up to a ninety-day no-trespass order;

C.  Upon a third violation within a twelve-month period, up to a twelve-month no-trespass order.  (Ord. 1500 §5, 2002).

12.22.060 Criminal trespass--Violating a no-trespass order.

A person is guilty of second-degree criminal trespass by violating a no-trespass order issued by the court pursuant to this chapter.  (Ord. 1500 §6, 2002).
