3.12.010 Establishment of small works roster.

There is hereby established for the town of Concrete a small works roster comprised of all contractors who request to be on the roster and who are, where required by law, properly licensed or registered to perform contracting work in the state of Washington. [Ord. 793, 2018; Ord. 406 § 1, 1996]

3.12.020 Publication and required information.

The small works roster shall be established as follows:

(1) At least twice every year, the town council shall publish in a newspaper of general circulation a notice of the existence of the small works roster and shall solicit the names of contractors for such roster. The town shall add to the small works roster those qualified contractors who respond to the published notice and request to be included on the roster.

(2) In order to be included on the roster, the contractor shall supply information on a contractor qualification form to be provided by the town clerk. The contractor qualification form shall include, as a minimum, the name and address of the contractor, the contractor’s Washington registration number, and the contractor’s area(s) of work. If awarded a contract the contractor shall also provide information for the contractor’s insurance company and the contractor’s bonding company. [Ord. 793, 2018; Ord. 406 § 2, 1996]

3.12.030 Procedure.

The small works roster shall be utilized as follows:

(1) Whenever the town of Concrete seeks to construct any public work or improvement, the estimated cost of which, including costs of materials, supplies, and equipment, is between $35,000 and $300,000, the small works roster may be utilized.

(2) When the small works roster is utilized, the town of Concrete shall invite proposals from at least five qualified contractors on the small works roster, whenever possible.

(a) If estimated cost of work is between $150,000 and $300,000 the town will notify remaining qualified contractors on the small works roster that proposals are being sought by either:

(i) Publication of notice in the town’s legal newspaper of record;

(ii)     Mailing a notice to the additional contractors;

(iii) Sending the notice by facsimile, or other electronic means.

(3) The town shall not favor certain contractors on the small works roster over other contractors who perform similar services.

(4) Proposal invitations shall be provided at least 21 days prior to the date the proposals are due.

(5) The invitation to submit proposals shall include an estimate of the scope and nature of the work to be performed and the materials and equipment to be furnished, if any.

(6) Proposals must be sealed and filed at the location specified and by the date and time specified in the invitation for proposals; provided, however, the town shall reserve its right under applicable law to reject any or all proposals and to waive procedural irregularities.

(7) When awarding a contract for work under the small works roster, the town of Concrete shall award the contract to the contractor submitting the lowest responsible bid; provided, however, that the town of Concrete reserves its right under applicable law to reject any or all bids and to waive procedural irregularities.

(8) Once a contractor has been afforded an opportunity to submit a proposal, that contractor shall not be offered another opportunity until all other appropriate contractors on the small works roster have been afforded an opportunity to submit a proposal.

(9) Immediately after an award is made, the bid quotations obtained shall be recorded, open to public inspection, and available by telephone inquiry.

(10) A contract awarded from the small works roster under this chapter need not be advertised.

(11) Small works roster proposals between $35,000 and $300,000 shall be brought before the town council for approval. [Ord. 793, 2018; Ord. 406 § 3, 1996]

3.12.040 Limited public works – Small works roster procedure.

(1) If a work, construction, alteration, repair or improvement project is estimated to cost less than $35,000, the town may award such a contract using the limited public works roster process provided under RCW 39.04.155(3).

(2) Department to Contact Contractors Off the Small Works Roster. Invitation for quotations shall include an estimate of the scope and nature of the work to be completed, materials and equipment to be furnished and the date, time and location to return the quote. Details plans and specifications need not be included in the invitation.

(3) A minimum of three electronic or written quotations shall be solicited whenever possible.

(4) The town may waive the payment and performance bond requirements of Chapter 39.08 RCW and the retainage requirements of Chapter 60.28 RCW, thereby assuming the liability for the contractor’s nonpayment of laborers, mechanics, subcontractors, material persons, suppliers, and taxes imposed under RCW Title 82 that may be due from the contractor for the limited public works project, however the town shall have the right of recovery against the contractor for any payments made on the contractor’s behalf.

(5) The town will maintain a list of contractors contracted and contracts awarded during the previous 24 months under the limited public works process, including contractor name, registration number, amount of contract, brief description of work and the date the contract was awarded.

(6) Prevailing wage shall be required.
