6.12.010 Keeping of poultry or fowl.

The town council finds that the keeping of fowl in violation of this chapter constitutes a danger to the health, safety and welfare of the residents of the town of Concrete and the public in general. Therefore, the keeping of fowl in violation of this chapter constitutes a public nuisance which is to be administered and enforced according to Chapter 8.04 CMC. [Ord. 806, 2019]

6.12.020 Keeping of certain fowl and poultry prohibited.

The keeping of poultry or fowl, if allowed, shall only be allowed in the residential zoning. It shall be unlawful for any person for any reason to keep or harbor within the corporate limits of the town of Concrete any roosters, turkeys, geese, ducks, peacocks, pigeons, birds of prey or game birds. 6.12.030 Chickens – Enclosures.

It shall be unlawful for any person to keep or harbor within the corporate limits of the town of Concrete any chickens unless the same are kept at all times in a suitable enclosure meeting at least the following minimum requirements:

(1) Indoor Enclosures.

(a) The enclosure shall be a separate structure from that of any other structure whose main purpose is for human occupancy.

(b) Shall only be placed in the rear yard.

(c) A minimum of three square feet per chicken within the enclosure.

(d) Maximum of 25 chickens shall be allowed.

(e) Must be at least 25 feet away from any neighboring dwelling.

(f) Must be at least 10 feet away from any property line (unless abutting an alley).

(g) Shall meet maximum land coverage and height stated in CMC 19.15.050(3)(b) and CMC 19.15.050(4) and (4)(b).

(h) Must be well ventilated and enclosed to protect chickens against weather conditions and predators.

(i) Shall be kept in a neat, sanitary, dust-free condition.

(j) Must be cleaned on a regular basis but not less than once every 14 days.

(2) Outdoor Enclosures.

(a) Shall only be placed in the rear yard.

(b) A minimum of 10 square feet per chicken.

(c) Maximum of 25 chickens shall be allowed.

(d) Fencing shall be adequate to keep the chickens within the closure but shall not exceed six feet in height.

(e) Must be at least 25 feet away from any neighboring dwelling.

(f) Must be at least 10 feet away from any property line (unless abutting an alley).

(g) Shall be considered a structure in regards to maximum land coverage and shall meet the requirements of CMC 19.15.050(3)(b).

(3) Enclosures on Vacant Lots. Enclosures may be allowed on vacant lots following the same requirements for either indoor or outdoor enclosures as well as the maximum number of chickens allowed. [Ord. 806, 2019]

6.12.040 Chickens – Running at large prohibited.

No chickens shall be permitted to run at large within the corporate limits of the town of Concrete and the running at large of any such chicken is hereby declared to be a nuisance, and any person being the owner or possessor of any such fowl, or who, having the management, charge or control thereof, shall permit the same to run at large, may be fined in any sum not exceeding $100.00 per occurrence. 6.12.050 Maintaining offensive conditions.

No owner or caretaker, either willfully or by failure to exercise due care, shall permit chicken waste to accumulate on the owner’s or caretaker’s property or to allow the keeping of such chickens to kept in such a manner as to be nauseous, foul or offensive to any community neighbor, family, or person within the town limits. 6.12.060 Storage and disposal of waste.

The storage of all waste shall be done in a sealed, airtight container until such time as the waste is properly disposed of. Proper disposal shall be the responsibility of the owner or caretaker of such property. [Ord. 806, 2019]

6.12.070 Violations and enforcement.

Violations and enforcement of this chapter shall follow the same procedures as outlined in CMC 8.04. [Ord. 806, 2019]
