15.04.010 Title.

This chapter shall be known as the “Building Code of the Town of Concrete, Washington.” [Ord. 532, 2004]

15.04.020 Purpose.

The purpose of this chapter is to establish and enforce minimum standards of construction, alteration and removal of buildings and other structures, including mechanical, fire and plumbing provisions, within the limits of this municipality. The provisions of this chapter apply to any structure or part of any structure. [Ord. 532, 2004]

15.04.030 Structures defined.

“Structures” means any assembly or material erected in a more or less permanent location and described by the use for which it is intended. [Ord. 532, 2004]

15.04.040 International and uniform codes adopted.

(1) This code shall consist of the following codes which are hereby adopted by reference:

(a) International Building Code, 2021 Edition, published by the International Code Council Inc., together with supplements thereto including International Swimming Pool and Spa Code; Standards for Accessibility; mandated by Washington State amendments and/or exceptions as contained in Chapter 51-50 WAC; and Appendix E and ICC A117.1-2017 (Washington State amendments); International Building Code and International Building Code Appendices C, G, J and P; as adopted by the state of Washington.

(b) International Residential Code for One- and Two-Family Dwellings, 2021 Edition, as published by the International Code Council, Inc., except Chapters 11 and 25 through 43, together with supplements thereto, and Appendices F, Q, T, U, Y, and Z; as mandated by Washington State amendments, additions, deletions and exceptions in Chapter 51-51 WAC.

(c) International Mechanical Code, 2021 Edition, published by the International Code Council, Inc., and supplements thereto, together with all Washington State amendments and exceptions as contained in Chapter 51-52 WAC.

(d) Except as provided in RCW 19.27.170, Uniform Plumbing Code and Uniform Plumbing Code Standards 2021 Edition, published by the International Association of Plumbing and Mechanical Officials (IAPMO) together with supplements and amendments thereto; mandated Washington State amendments and exceptions as contained in Chapters 51-56 and 51-57 WAC, Appendix Chapters A, B, I and M; provided, that Chapters 12 and 14 are not adopted; provided further, that those requirements of the Uniform Plumbing Code relating to venting and combustion air of fuel appliances and those portions of the code addressing building sewers are not adopted.

(e) International Fire Code, 2021 Edition, published by the International Code Council, Inc., including those standards of the National Fire Protection Association, specifically referenced in the International Fire Code; provided, that notwithstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying hand-held candles and amendments and additions thereto; supplements thereto; mandated by Washington State amendments and exceptions as contained in Chapter 51-54 WAC and Appendices B, C, D, and H, including 2021 International Wildland-Urban Interface Code, published by the International Code Council and 2023 Edition of NFPA 855, Standards for Installation of Stationary Energy Storage Systems.

(f) The 2021 International Fuel Gas Code as published by the International Code Council, Inc., together with standards 2020 NFPA 58 and 2021 NFPA 54.

(g) International Existing Building Code, 2021 Edition, as published by the International Code Council, including Appendix A.

(h) The 2015 International Energy Conservation Code known officially as Washington State Energy Code, 2021 Edition, for residential and commercial, published by the International Code Council, together with supplements and amendments thereto, per Chapters 51-11C and 51-11R WAC.

(i) Installation of factory-built housing and commercial structures, RCW 43.22.460, together with WAC 296-150C-0540 and 296-150F-0540, and the installation of manufactured and mobile homes, RCW 43.22.440, and WAC 296-150M-0650.

(j) The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, an amendment published by the International Conference of Building Officials.

(k) IAPMO Uniform Green Plumbing and Mechanical Code Supplement 2012 Appendix B for potable rainwater catchment systems.

(l) International Property Maintenance Code, 2021 Edition, published by the International Code Council.

(m) All references to the Uniform Building Code which may exist in the Concrete Municipal Code shall be interpreted to refer to the International Building Code.

15.04.050 Violation – Penalty.

(1) It is unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, convert, or demolish, equipment, use, occupy or maintain any building or structure in the town, or cause the same to be done, contrary to or in violation of any of the provisions of this chapter.

(2) Any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any provisions of this code is committed, continued or permitted, and upon conviction of any such violation, such person shall be punishable for a fine of not more than $300.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. 15.04.060 Building permit and plan review fees.

(1) Fees shall be assessed in accordance with the provisions of this section.

(a) Fees shall be assessed as designated in the current town of Concrete fee schedule as adopted by resolution of the town council and on file with the clerk-treasurer.

(b) Any plan review fees that are required shall be paid at the time of submitting a building permit application.

(c) Building permit fees shall be determined by the building inspector by using the current building valuation data distributed by the International Code Council. The applicant shall pay the building permit fee(s) prior to the building department issuing a building permit.

(d) Upon notification by the town that permit application has been approved, the applicant shall submit payment to the town for all permit fees for which approval has been received prior to permit application expiration. All permit application shall expire six months from the date the application was submitted. Notification shall be given by any means reasonably calculated by the town to provide the applicant with notice that the applicant’s permit may be issued and may include notice by telephone, facsimile, e-mail or through the U.S. mail. The applicant shall promptly advise the town of any changes that would limit or otherwise hinder the town in contacting the applicant.

(e) Upon payment of all permit fees, permit shall be valid for one year from the date the permit is issued.

(i) A six-month extension from the expiration date of the initial permit may be granted at 50 percent of the original building permit cost to the applicant by written request.

(ii) If the building permit issued has not been inspected and finalized by the building inspector or his designee within one year and six months of the original issue date, the town shall require a new application including the payment of any building permit fees at the current cost at time of the new application.
