16.08.010 North West Air Pollution Authority.

A program of air resources management should be and hereby is initiated, said program to begin with:

(1) The formation of an air pollution authority in accordance with the provisions of Chapter 70.94 RCW and amendments thereto, such authority being necessary for effective, efficient and equitable air pollution control.

(2) The air pollution authority shall include, but not limited to Skagit County, and to include Burlington, Mount Vernon, Sedro-Woolley, Anacortes, Concrete, Lyman, Hamilton, LaConner and Skagit County. The town of Concrete hereby agrees, together with the cities, towns, and the county participating in the authority as follows:

(a) That the name of the authority shall be the “North West Air Pollution Authority.”

(b) The geographic area of the authority shall include the unincorporated area of Skagit County and the incorporated area of the participating cities or towns, to the end that all of the area within Skagit County shall be a part of the participating jurisdiction of the authority.

(c) The principal office and place of business of the authority shall be Mount Vernon, Skagit County, Washington, or at such other place as the board of directors of the authority may from time to time agree upon by majority vote.

(d) That the authority shall begin to transact business and establish programs and exercise its powers on or after October 18, 1966. It shall continue in active operation for such period of time and to such time as the board of directors of the authority may find necessary to conduct research and studies and/or effectuate controls with respect to air pollution.

A copy of the ordinance codified in this chapter shall be forthwith filed with the secretary of the state of Washington, with the county treasurer and the county auditor, and with each of the participating cities, towns, or agencies. [Ord. 177 § 1, 1966]
