GENERAL PENALTY

1.04.010 Designated.

(a)    Unless this code specifies other penalties, any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code is guilty of a misdemeanor. Any person convicted of a misdemeanor under this code shall be punished by a fine of not more than five thousand dollars, or by imprisonment not to exceed three hundred sixty-five days, or by both such fine and imprisonment.

(b)    Civil Penalty. Unless otherwise indicated, all violations of the Connell Municipal Code designated as civil infractions shall be punished by a civil penalty equal to the maximum penalty under state law for a class 1 civil infraction set forth in RCW 7.80.120 as currently enacted and hereafter amended. Proof of violation of civil infractions shall be by a preponderance of the evidence. Civil infractions may be heard before a duly appointed municipal court judge. Traffic infractions provided for in Chapter 308-330 WAC are specifically excluded for this chapter.

(c)    Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued, or permitted by any such person, and he is punishable accordingly.
