17.01.010 Title.

This title is known as the “zoning ordinance of the city of Connell.” (Ord. 923 § 1 (part), 2012: Ord. 689 § 1 (part), 1997. Formerly 17.03.010).

17.01.020 Purpose.

The purpose of this title is to:

(1)    Promote the health, safety, morals, convenience, comfort, prosperity and general welfare within the city and its immediate environs; promote the orderly, compatible use of land; promote the city’s growth consistent with the Washington State Growth Management Act (RCW 36.70A.020); and promote and implement the City’s Comprehensive Plan adopted pursuant to the Act; and

(2)    Establish specific zones and regulations necessary for the proper development of utilities, schools, parks, housing, essential light, air, privacy and open spaces; lessen the congestion of streets and to promote the safe movement of traffic; stabilize and protect property values; prevent overcrowding and substandard housing; promote an environmentally healthy city; promote the community’s economic development and the prosperity and welfare of its citizens; and to establish an attractive city within which to live; and

(3)    Develop regulations establishing the location, height and use of buildings, the use of land, the size of yards, off-street parking and loading zones and other necessary spaces; and such other reasonable or necessary regulations of the use of land, within their respective zones, which promote the general welfare and are necessary for the proper police and sanitary regulation of the city. 17.01.040 Conflicting provisions.

If any provision of this title conflicts with any other, the more restrictive applies. (Ord. 923 § 1 (part), 2012: Ord. 689 § 1 (part), 1997. Formerly 17.03.040).

17.01.050 Violations—Penalties.

(a)    Any person convicted of a violation of any provision of this title shall be punished by a fine of not more than five thousand dollars or by imprisonment for not more than one year, or by both such fine and imprisonment. For any violation of a continuing nature, each day’s violation shall be considered a separate offense and subject the offender to the above penalties for each offense.

(b)    In addition to the enforcement provisions of this section, any violation of any of the provisions of Section 17.19.120 is declared to be a public nuisance, per se, which may be abated by the city attorney by way of civil abatement procedures. (Ord. 1006 § 1 (Exh. A) (part), 2020).
