17.04.010 Purpose.

This chapter provides procedures for amending, supplementing or changing this title and the official zoning map. (Ord. 923 § 1 (part), 2012: Ord. 689 § 1 (part), 1997. Formerly 17.78.010).

17.04.020 Amendments.

(a)    Zoning text amendments, amendments of development regulations, and area-wide amendments to the zoning map or overlay districts shall be applied for and processed in accordance with Section 16A.02.060, Legislative actions—Definition and approval process. Site-specific changes to the zoning map shall comply with all provisions of Title 16A with the exception of Section 16A.02.060.

(b)    Resubmission of Petition. Any petition for a change of site-specific zone which is denied may be resubmitted after six months of the action taken. (Ord. 1006 § 1 (Exh. A) (part), 2020: Ord. 934 § 1, 2012: Ord. 923 § 1 (part), 2012: Ord. 689 § 1 (part), 1997. Formerly 17.78.020, 17.28.030).

17.04.040 Procedure—Text amendments.

(a)    Any text amendment to this title may be initiated by the planning commission, the city council or any interested person who owns property, resides, or conducts business activities in the city. If a proposed amendment conflicts with the comprehensive plan, consideration of the application shall be tabled until such time as the city has completed its annual review of the comprehensive plan and has changed the comprehensive plan so as to eliminate the conflict.

(b)    Applications to amend this title must be on forms supplied by the administrator and must contain the information stated thereon, as well as the application requirements which accompany the application.

(c)    All amendments require at least one public hearing at the planning commission, which will recommend action to the city council. The council need not hold a public hearing. If the planning commission recommends to deny a request to amend this title, the amendment is not forwarded to the city council for further consideration unless the action is appealed to the council within fourteen days of the recommendation.
