CD (COMMERCIAL, DOWNTOWN) DISTRICT

17.12.010 Purpose.

The purpose of the CD district is to stabilize, improve and orient the downtown area for pedestrian use, and to provide for the orderly growth of the area by encouraging the opportunity for a wide range of retail commercial uses. 17.12.020 Permitted uses.

The following uses are the only uses permitted in a CD district:

(1)    Shopping plazas, specialty shops, sales and service establishments;

(2)    Financial institutions; business and professional offices; medical, dental, physical therapy;

(3)    TV, newspaper publishing offices and radio studios;

(4)    Hotels, motels, theaters, lodges, clubs; restaurants, taverns, nightclubs and cocktail lounges;

(5)    Business schools, studios and academies for the arts;

(6)    Residential uses allowed in all residential zones are allowed on upper floors and within non-street frontage areas of the site;

(7)    Accessory uses and buildings related to permitted uses in accord with Chapter 17.22;

(8)    Manufacture and repair provided retail sales occur on the premises;

(9)    Off-street parking lots in accord with Chapter 17.20;

(10) Automobile service stations, auto sales, drive-in restaurants, and similar auto-oriented uses in accord with Section 17.19.030; self-service laundries, cleaning and laundry pickup stations;

(11) Public and quasi-public uses oriented toward pedestrians, such as civic buildings, museums, libraries and the like;

(12) Nursery schools, child day care and day care facilities in accord with Sections 17.19.140 and 17.19.150;

(13) Group home for handicapped persons in accord with Section 17.19.160;

(14) Adult family home; and

17.12.030 Uses requiring a conditional use permit.

The following uses require a conditional use permit in accord with Chapter 17.23:

(1)    Public and quasi-public uses, other than those permitted in Section 17.12.020 (Section 17.23.020);

(2)    On-site hazardous waste treatment and storage facilities when accessory to any permitted use except residential and subject to state siting criteria;

(3)    Other uses deemed similar in accord with Section 17.23.030; and

17.12.040 Development standards.

In addition to the specific regulations set forth in this title and the standards set forth in or adopted by this code, development standards in the CD district shall include:

(1)    Minimum setbacks: front—none, but ten feet if abutting a residential district; side and rear—none, but twenty feet if abutting a residential district;

(2)    Building height: forty-five feet;

(3)    Off-street parking: in accord with Chapter 17.20;
