17.24.010 Purpose.

Overlay districts are intended to promote organized development, preservation and use of established areas. The regulations are in addition to the underlying zone. Overlay districts will be used for special areas, requiring special regulations. (Ord. 1006 § 1 (Exh. A) (part), 2020: Ord. 923 § 1 (part), 2012: Ord. 689 § 1 (part), 1997. Formerly 17.81.010).

17.24.020 Permitted uses.

Only those uses permitted in the underlying zoning district are permitted in an overlay district. Uses may, however, be expanded, modified or restricted by the provisions of the overlay district. If there is a conflict between the overlay district and the underlying zoning district, the overlay zoning regulations will prevail. The establishment of an overlay zone repeals any special condition or limitation on a zoning classification within an overlay district. (Ord. 923 § 1 (part), 2012: Ord. 689 § 1 (part), 1997. 17.24.030 Procedure to establish.

Overlay zones are established in accord with Title 16A. However, the matter will not be scheduled for required open record hearings until the administrator and property owner(s) have developed overlay regulations. Open record hearings will include public review of the proposed regulations and boundaries of the proposed overlay district. (Ord. 1006 § 1 (Exh. 17.24.040 Amendments.
