Article I. Usage Regulations

10.30.010 Definitions.

The following words and phrases when used in this chapter shall, for the purposes of this chapter, have the meanings respectively ascribed to them in this section:

“Bicycle” means a vehicle consisting of two wheels held in a frame one behind the other, propelled by petals and steered with handlebars attached to the front wheel.

“Roller skate” means a pair of shoes, mounted upon wheels and is most often propelled by the user in an upright, standing position or kneeling.

“Scooter” means a foot board mounted upon two or more wheels and controlled by an upright steering handle. This device is propelled by the user in usually an upright position.

“Skateboard” means a foot board mounted upon four or more wheels and is usually propelled by the user who sometimes stands, sits, kneels or lays upon the device while it is in motion.

“To operate in a negligent manner” means the operation of one or more of the above-described devices in such a manner as to endanger or be likely to endanger any person or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic control devices and failure to yield right-of-way to pedestrians and/or vehicular traffic. 10.30.020 Traffic regulations.

Any person operating a skateboard, bicycle, roller skates, scooter or any other recreational vehicle propelled solely by human power shall obey the instructions of official traffic control signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer. 10.30.030 Speed.

No skateboard, bicycle, roller skates, scooter or any other recreational vehicle propelled solely by human power shall be ridden in a negligent manner but shall be operated with reasonable regard for the safety of the operator and other persons. (Ord. 593 § 3, 2003; Ord. 590 § 3, 2003)

10.30.040 Prohibited areas.

It is unlawful for any person to operate or ride upon any skateboard on the sidewalk or the street in the following areas of the town of Coulee Dam:

(1) Sixth Street, from Birch Street to Aspen Street.

(2) West side of Birch Street, from Sixth Street to Roosevelt Street.

(3) North side of Roosevelt Street, from Birch Street to River Drive.

(4) Inside of the Community Building.

(5) West side of Fir Street, from Sixth Street to Mead Way.

(6) North side of Mead Way, from Fir Street to Cedar Street.

10.30.050 Violation – Penalty.

Any person violating this article shall be guilty of a civil infraction, and upon the finding of a violation thereof, shall be subject to a monetary penalty not less than $50.00 and no more than $500.00. Further, the device ridden at the time of violation shall be subject to impound for a period of 10 days. Each day during which a violation continues shall be deemed a separate offense and separate penalties may be assessed for each separate offense. The prevailing party in a civil infraction case may be awarded costs; provided, however, that attorney fees shall not be awarded to either party in a civil infraction case. Whenever a monetary penalty is imposed by a court for violation of a town ordinance, it is payable immediately. (Ord. 590 § 5, 2003)

Article II. Mason Park

10.30.060 Mason Park plaza area.

It is unlawful for any person to operate a skateboard, bicycle and any other recreational vehicle propelled solely by human power, within the plaza area of Mason Park, or for any person to climb on the plaza wall within Mason Park. (Ord. 573 § 1, 2002)

10.30.070 Violation – Penalty.

Any person violating this article shall be guilty of a civil infraction, and upon the finding of a violation thereof, shall be subject to a monetary penalty of not more than $500.00 and the confiscation of the skateboard, bicycle, or other nonmotorized recreational vehicle operated solely by human power. Each day during which a violation continues shall be deemed a separate offense and separate penalties may be assessed for each separate offense. The prevailing party in a civil infraction case may be awarded costs; provided, however, that attorney fees shall not be awarded to either party in a civil infraction case. Whenever a monetary penalty is imposed by a court for violation of a town ordinance, it is payable immediately. (Ord. 573 § 2, 2002)
