The board of commissioners of Cross Valley Water District hereby adopts the following policy for collection of delinquent assessments:

(1) Payment Delinquent One Year. If an annual installment of a ULID assessment is not paid on the due date, the district shall require the property owner to pay the amount of the delinquent principal and interest, plus the required penalty amount if paid within 60 days after the date the installment is one year delinquent. If the delinquent installment is made more than 60 days after the date the installment is one year delinquent, then the district shall collect interest to the next due date as well.

(2) Payment Delinquent Two Years. If two installments of an assessment are delinquent, the district shall require the property owner to pay all interest and penalties to the next due date, plus one installment of principal but allow one year’s installment of principal to remain outstanding.

If a property owner desires to make payment on a delinquent ULID assessment on any other basis, the property owner must obtain approval from the board of commissioners, and the district may not accept the payment of any amount until the board has approved the payment terms. [Res. 1992-9-3.]
