5.12.010 Definitions.

“Machine or game of skill” means, for the purposes of this chapter, any machine or electrical or mechanical device designed to be operated as a game of skill and/or for amusement, by the insertion of a coin, the result of the operation of which is not dependent upon chance or an uncertain or contingent event. “Music machine” means any electrical or mechanical machine or device designed to be operated for the recording or reproduction of the human voice, music or any sound whatsoever, by the insertion of a coin. 5.12.020 Unlawful operation.

It is unlawful for any person, firm or corporation whether as owner, manager, agent, dealer, clerk or employee, to sell, lease, distribute, operate or permit to be operated or used, or to possess with intent to use or operate, whether for hire or not, any game of skill, music machine, or other coin operated machine as described in DMC 5.12.010, within the limits of Davenport, without first having obtained a license to operate same from the city clerk-treasurer as provided in this chapter. (Ord. 314 § 2, 1950).

5.12.030 License – Fees.

For the privilege of operating games of skill, or music machines, each person, firm or corporation desiring to operate such a device within the limits of the city shall procure a license as follows: Persons desiring to operate a game of skill as defined in DMC 5.12.010, shall pay to the city clerk-treasurer the sum of $20.00 per year for each and every machine so operated. Said license shall be payable annually for each year, or portion thereof, for any machine which is so operated. Persons desiring to operate any music machines as defined in DMC 5.12.010 shall purchase a license for each such machine at the rate of $10.00 for each machine so operated in the city, said license to be payable annually, in advance, for each year or portion thereof in which any machine is to be so operated. Upon payment of said license fee, the city clerk-treasurer shall issue a license or receipt which shall show plainly thereon the year for which it is issued, the expiration date thereof, and shall be displayed upon the machine, contrivance, game or device for which it is issued at all times in full view of the player thereof. 5.12.040 Minor use unlawful – Unlawful hours of operation.

It is unlawful for any person under the age of 21 years to play any game of skill or other coin-operated machine (other than music machines) as defined in DMC 5.12.010 and it is unlawful for any person, whether as owner, manager, agent, dealer, clerk or employee, to permit any person under the age of 21 years to play or operate any of said devices within the limits of the city. It is unlawful to operate such machines between the hours of 12:00 midnight and 6:00 a.m. (Ord. 314 § 4, 1950).

5.12.050 Penalty for violation – License revocation.

Any violation of this chapter, upon conviction thereof, shall be punishable as provided in DMC 1.04.010, and the license granted may be revoked. Any machine used or operated or maintained in violation of this chapter may be confiscated and destroyed as contraband by the duly authorized officers of the city.

Any license issued in accordance with the provisions of this chapter shall be revokable at any time by the council. (Ord. 314 § 5, 1950).
