9.12.010 Definitions.

(a) “Parent or guardian” means the actual parent or legal guardian or a person that has the care, custody or control of such minor by consent of the parent or legal guardian or by court action.

(b) “Public place” includes but is not limited to places of amusement, parks, playgrounds, dance halls, and similar premises open to the public.

(c) “Street” means any alley, thoroughfare, pathway, or other course of travel open to the public.

(d) “Unoccupied premises or grounds” includes all areas and premises of the city except those premises designed as dwellings or places of residence and presently occupied by such residents.

Masculine gender as used in this chapter shall include the feminine gender and singular shall include plural. (Ord. 343 § 1, 1956).

9.12.020 Minor under 18 – Hours – Exceptions.

It is unlawful for any person under the age of 18 years to congregate, loiter, or be on the streets in vehicles or otherwise, in public places, or upon unoccupied premises, or grounds in the city in the nighttime after the hour of 11:00 p.m. on Sunday, Monday, Tuesday, Wednesday, Thursday, and after the hour of 12:00 midnight on Friday and Saturday of each week unless such person shall be accompanied by his parent, or legal guardian, or is sent by his parent or legal guardian on some urgent business or errand, which renders it necessary for him to be abroad after the hours mentioned, in which case, such person shall personally have with him the written consent of his parents or guardians; provided, that nothing in this section shall be interpreted as prohibiting minors from traveling over and along public streets by direct route to and from work in the regular course of employment where such occupation and employment has been approved by authorities under procedure outlined by statute, in such cases where such approval is necessary, and such minor has in his possession evidence of such approval. 9.12.030 Parent responsibility.

It is unlawful for any parent or guardian, as defined in DMC 9.12.010, wilfully or negligently, to permit a minor under the age of 18 years who is subject to his custody to violate any of the provisions of this chapter, nor shall any such parent or guardian issue a written consent as provided in DMC 9.12.020 except in cases of necessity. 9.12.040 Time standard.

The hours indicated in DMC 9.12.020 are with reference to the standard time prevailing in the city from period to period, whether it be what is commonly accepted as Pacific Standard Time or Pacific Daylight Saving Time. (Ord. 343 § 6, 1956).
