9.28.010 Alcoholic content of beer and wine – Permit required.

The sale of any vinous, distilled, fermented or malt liquor, except beer having an alcoholic content not greater than four percent by weight, and except wine having an alcoholic content not greater than 17 percent by weight, by any person, firm or corporation, except by the Liquor Board of the state and its duly authorized vendors, agents, servants and employees, and druggists holding a special permit from the Liquor Board of the state so to do, is prohibited. (Ord. 266 § 1, 1934).

9.28.020 Beer – Sale.

The sale of beer having an alcoholic content of four percent or less by weight by the individual glass or open bottle at retail for consumption on the premises, except in hotels, restaurants, clubs, taverns, drugstores, or soda fountains which have a license in force so to do, duly issued by the Liquor Board of the state, is prohibited. (Ord. 266 § 2, 1934).

9.28.030 Wine – Sale.

The sale of wine having an alcoholic content of 17 percent or less by weight by the individual glass or open bottle at retail for consumption on the premises, except in hotels, restaurants and clubs, which have a license in force so to do, duly issued by the Liquor Board of the state, is prohibited. (Ord. 266 § 3, 1934).

9.28.040 Public place – Opening liquor.

Except as permitted by the State Liquor Act, no person shall open the package containing liquor or consume liquor in any public place. Every person who violates any provisions of this section shall be guilty of a misdemeanor and on conviction thereof, shall be punishable as provided in DMC 1.04.010. (Ord. 266 § 4, 1934).

9.28.050 Intoxicated person in public – Penalty.

No person who is intoxicated shall be or remain in any public place, and every person who violates any provision of this section shall be punishable as provided in DMC 1.04.010. (Ord. 266 § 5, 1934).

9.28.060 Sale to intoxicated person.

No person shall sell any liquor to any person apparently under the influence of liquor, wine or beer. (Ord. 266 § 6, 1934).

9.28.070 Minor.

Except in the case of liquor given or permitted to be given to a person under the age of 21 years by his parent or guardian for beverage or medical purposes or administered to him by his physician for medicinal purposes, no person shall give or supply liquor to any person under the age of 21 years or permit any person under that age to consume liquor on his premises or on any premises under his control. (Ord. 266 § 7, 1934).

9.28.080 Sale without license.

Every person doing an act required to be licensed under the State Liquor Act without having in force a license issued to him under that act shall be guilty of a misdemeanor. (Ord. 266 § 8, 1934).
