10.50.010 Definitions.

For purposes of this chapter:

(1) “Engine compression brake” means a motor vehicle brake which is activated or worked by the compression of the engine of a motor vehicle. Compression brakes are also referred to as “exhaust brakes” or “Jake brakes.” (Ord. 900 § 1, 2002).

10.50.020 Prohibition – Exceptions.

(a) Engine compression brakes shall not be used at any time in the city by trucks or truck tractors except public safety emergency vehicles, or unless the noise created by their use is effectively muffled.

(b) It shall be an affirmative defense to prosecution under this section that the unmuffled compression brakes were applied in an emergency and were necessary for the protection of a person, an animal, or property. (Ord. 900 § 1, 2002).

10.50.030 Signage.

The city maintenance foreman shall have authority to post appropriate signs consistent with this section. An appropriate sign shall not be brand specific, i.e., it shall not mention “Jake brakes” or “Jacobs Engine brake.” (Ord. 900 § 1, 2002).

10.50.040 Violation – Penalty.

Violation of DMC 10.50.020 is a misdemeanor, and shall be punished by a maximum fine of $250.00. (Ord. 900 § 1, 2002).
