2.64.010 Board – Powers and duties.

In an advisory capacity the airport advisory board is granted authority to make recommendations to the city council, pursuant to Chapter 14.08 RCW, including, but not limited to, construction, enlargement, improvement, maintenance, equipment operation, and regulation of the airport and other air navigation facilities, so long as the decisions of the airport advisory board are consistent with the approved airport master plan, the Deer Park comprehensive plan, all other provisions of this code, applicable federal regulations, the annual airport budget, the airport capital improvement plan, airport minimum business standards, airport rules and regulations, and approved lease policies. The airport advisory board shall remain in all these things accountable to the city council. (Ord. 786 § 1, 2002)

2.64.020 Board – Size, term and members.

The advisory board shall be composed of seven directors, four of whom are residents of the city of Deer Park, and three are at-large members, one of which may be an airport lessee. Members shall serve without compensation. The term of each director shall be the remaining portion of any unexpired term to which he or she is appointed, or if to an expiring term, for four years. Not more than three terms shall expire in the same year. Terms shall run from January 1st in the year of appointment. All appointments shall be appointed by the mayor and confirmed by the council. 2.64.025 Alternate board members.

There shall be two alternate board members at all times. One alternate board member shall be a resident of the city of Deer Park and shall serve in the absence of any of the four regular advisory board members appointed as residents of the city of Deer Park. One alternate board member shall be an at-large alternate who shall serve in the absence of any of the three regular at-large advisory board members. The term of an alternate board member shall be four years. An alternate board member shall have all of the power and authority of a regular advisory board member and shall serve from time to time in the absence of a regular board member for which the alternate may serve. The initial term of each alternate board member shall commence on January 1st in the year of appointment. In the event of a vacancy in the position of alternate board member, a qualified individual may be appointed to serve the remaining portion of any unexpired term of the alternate board member. All appointments to the position of alternate airport advisory board member shall be made by the mayor, subject to council confirmation. (Ord. 960 § 1, 2016)

2.64.030 Board – Meetings and minutes.

The advisory board shall meet monthly on regularly scheduled dates and times established by the board and set forth in its policies. The board may, in addition, meet in special session if, within the times allowed by statute, sufficient notice is given of such meetings. Minutes of all meetings shall be submitted to the city clerk within one week of each meeting. (Ord. 786 § 3, 2002)

2.64.040 Airport management and personnel.

The airport advisory board may recommend to the city council the employment and discharge of an airport manager and other airport personnel as needed. (Ord. 786 § 4, 2002)

2.64.050 Adoption of rules and regulations.

The advisory board shall recommend to the city council adoption and amendment of all needed rules, regulations, and ordinances for the management, government and use of any properties under the board’s control, whether within or without the territorial limits of the municipality. Rules and regulations shall be adopted as ordinances of the city. They must conform to and be consistent with the laws of the state and the rules of the State Department of Transportation and shall be kept in conformity, as nearly as may be, with the then current federal legislation governing aeronautics and the regulations duly promulgated thereunder and the rules and standards issued from time to time pursuant thereto. 2.64.060 Lease of airport property.

The advisory board shall have the authority to recommend lease or rent of the airport properties or other air navigation facilities, or real property acquired or set apart for airport purpose, to private parties, any municipal or state government or national government, or any department thereof, for operation; provided, that terms of the lease are consistent with the approved lease agreement or as modified by the city council and that no exclusive use of public areas is granted and the public is not deprived of its rightful, equal, and uniform use of the property. 2.64.070 Creation of airport fund.

The city shall maintain a separate airport fund and provide that all receipts from the operation of the airport be deposited in the fund, which fund shall remain intact from year to year and may be pledged to the payment of aviation bonds, or kept for future maintenance, construction, or operation of the airport or airport facilities. 2.64.080 Determination of rents and charges to users.

The advisory board may recommend to the city council the charges or rental for the use of any properties under its control and the charges for any services or accommodations, and the terms and conditions under which such properties may be used; provided, that in all cases the public is not deprived of its rightful, equal and uniform use of such property. Charges shall be reasonable, uniform for the same class of service, and established with due regard to the property and improvements used and the expense of operation to the city. 2.64.090 Airport budget.

The airport manager, in collaboration with the advisory board, shall prepare and submit to the city a proposed annual operating budget. The city reserves the power to establish and approve the actual annual budget for the operation of the airport. All expenditures of funds by the board shall come from the annual budget.
