15.04.010 Adopted by reference.

The city of Deer Park hereby adopts by reference the uniform codes identified in this section, as they may be amended by the Washington State Building Code Council or the state of Washington pursuant to Chapters 19.27 and 19.27A RCW from time to time, for the purpose of establishing rules and regulations for the construction, alterations, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties. The codes adopted by reference herein, including all amendments thereto, shall be deemed a part of this section. Amendments to the codes adopted by reference herein shall be effective and enforceable as of the effective date of the approval of the codes by the state of Washington.

All references to RCWs and WACs set forth in this section shall be considered references to those RCWs and WACs as the same exist now or as they may hereafter be amended.

A. International Building and Residential Code (IBC and IRC).

1. The current edition of the International Building Code (IBC) published by the International Code Council, Inc., including all additions, deletions, and exceptions as set forth in Chapter 51-50 WAC, as the same now exists or as it may be hereafter amended, except such portions as may be deleted or modified by ordinance. The following appendices are specifically adopted:

Appendix E, Supplementary Accessibility Requirements.

Appendix G, Flood Resistant Construction.

Appendix J, Grading.

2. The current edition of the International Residential Code (IRC) published by the International Code Council, Inc., including all additions, deletions, and exceptions as set forth in Chapter 51-51 WAC, as the same now exists or as it may be hereafter amended, except such portions as may be deleted or modified by ordinance. The following appendices are specifically adopted:

Appendix E, Manufactured Housing Used as Dwellings.

Appendix F, Passive Radon Gas Controls.

Appendix H, Patio Covers.

Appendix J, Existing Buildings and Structures.

3. Fees for building permits issued under the IBC, IRC, IFC, IMC and UPC shall be as specified in the applicable code, unless alternative fees are established by city council resolution.

4. Design Requirements. The tables below contain the local climatic and geographic design criteria and Manual J heating and cooling design criteria (Manual J design criteria is provided by the ACCA).

*    Normalized ground snow loads are adopted as shown on the current Spokane County Ground Snow Load Map as it now exists or as it may hereafter be amended. Minimum roof snow loads are adopted as shown on the current Spokane County General Residential Roof Snow Load Map as it now exists or as it may hereafter be amended, except as otherwise set forth in this section. Minimum roof snow load for nonresidential occupancies shall be 45 lbs/ft2 or greater as determined by the building official in all cases where the minimum figure hereby established appears inadequate. Such determinations shall be based on analysis of local climate and topography and the publication “Snow Load Analysis for Washington” as published by the Structural Engineers Association of Washington.

5. a. Professional Preparation of Plans. The city shall require a Washington-licensed design professional, licensed under the provisions of Chapter 18.08 or 18.43 RCW or Chapter 308-12 WAC to prepare or oversee the preparation of plans for any building or structure containing five or more residential dwelling units or for doing design work including preparing construction contract documents and administering the contract for construction, erection, enlargement, alteration, or repairs of or to a commercial building of any occupancy.

b. Construction Plans. All submitted construction documents must be of sufficient detail to show the entire project with emphasis on the following:

i. Structural integrity;

ii. Life safety;

iii. Architectural barriers (ADA accessible compliance);

iv. Compliance with all applicable codes;

v. Scope of work;

vi. Special inspection requirements and protocols.

In general, the amount of detail required will vary, depending on the nature and complexity of the project.

B. International Mechanical Code (IMC). The current editions of the International Mechanical Code (IMC) and International Fuel Gas Code published by the International Code Council, Inc., including all additions, deletions, and exceptions, as the same now exist or as they may be hereafter amended, except such portions as may be deleted or modified by ordinance, and except that the standards for liquefied petroleum gas installations shall be NFPA 58 (Storage and Handling of Liquefied Petroleum Gases) and ANSI Z223.1/NFPA 54 (National Fuel Gas Code).

C. International Fire Code (IFC). The current edition of the International Fire Code (IFC) published by the International Code Council, Inc., including those standards of the National Fire Protection Association specifically referenced in the International Fire Code and including all additions, deletions, and exceptions as set forth in Chapter 51-54A WAC, as the same now exists or as it may be hereafter amended, except such portions as may be deleted or modified by ordinance; provided, that, notwithstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying hand-held candles. The following appendices are specifically adopted:

Appendix B, Fire Flow for Buildings.

Appendix C, Fire Hydrant Locations and Distribution.

Appendix D, Fire Apparatus Access Roads.

D. Uniform Plumbing Code (UPC). Except as provided in Chapter 19.27 RCW, the current editions of the Uniform Plumbing Code (UPC) and Uniform Plumbing Code Standards, published by the International Association of Plumbing and Mechanical Officials, as the same now exist or as they may be hereafter amended, except such portions as may be deleted or modified by ordinance; provided, that any provisions of such code affecting sewers or fuel gas piping are not adopted, and the rules adopted by the Washington State Building Code Council establishing standards for making buildings and facilities accessible to and usable by physically disabled or elderly persons as provided in RCW 70.92.100 through 70.92.160 are adopted.

E. Washington State Energy Code. The current edition of the Washington State Energy Code, as amended by the Washington State Building Code Council, including all additions, deletions, and exceptions as set forth in state law and as identified in WAC Title 51, as the same now exists or as it may be hereafter amended, except such portions as may be deleted or modified by ordinance.

F. International Existing Building Code. The current edition of the International Existing Building Code, as amended by the Washington State Building Code Council, including all additions, deletions, and exceptions as set forth in state law and as identified in WAC Title 51, as the same now exists or as it may be hereafter amended, except such portions as may be deleted or modified by ordinance.

G. International Swimming Pool and Spa Code. The current edition of the International Swimming Pool and Spa Code as adopted by the Washington State Building Code Council, including all additions, deletions, and exceptions as set forth in state law and as identified in WAC Title 51, as the same now exists or as it may be hereafter amended, except such portions as may be deleted or modified by ordinance.

H. The 1997 Uniform Code for the Abatement of Dangerous Buildings. For purposes of Section 205 of Chapter 2, Enforcement, the hearing examiner for the city of Deer Park is designated as the board of appeals. 15.04.020 Fireworks stands.

Chapter 212-17 WAC and Chapter 70.77 RCW are adopted by reference and shall apply as if entirely set forth herein. The building official may revoke any permits issued and order “closed” any fireworks stand found to be: (1) in noncompliance with the provisions of this title; (2) a traffic hazard; (3) hazardous to property; (4) dangerous to any person; or (5) erected so as to constitute a nuisance or fire hazard. Any stand so ordered which is not brought into conformance within 24 hours of notification shall immediately close and shall not reopen until authorized by the building official. The building official, with assistance of the public works department, may barricade access to fireworks stands ordered closed, and the property on which they are located.

A. Storage of Fireworks. Fireworks for sale in stands shall be stored on-site in a secure manner and be under continuous supervision.

B. Fireworks Stand Requirements. All stands shall conform to the following:

1. Construction of fireworks stands need not specifically comply with the building codes of the city, but shall be erected in a safe manner and of such material as will ensure safety and shall be approved by the department.

2. Each fireworks stand shall have at least two exits. Exits shall be unobstructed at all times and will not have any locking or

latching device installed on the inside of the stand.

3. Fireworks stands shall not be located within 50 feet of any other building or structure, nor within 50 feet of the property line of any gasoline station, oil storage tank or premises where flammable liquids are kept or stored and shall be located a minimum of 25 feet from the roadway.

4. Each fireworks stand shall have two 2A 10BC approved fire extinguishers and two open containers, of a minimum two-gallon capacity, full of water located in a readily accessible location.

5. All weeds, grass and other combustible material shall be cleared from the temporary stand to a distance of at least 25 feet.

6. Smoking shall not be permitted in or within 25 feet of fireworks stands. “No Smoking” signs shall be posted on the premises.

7. An adult shall be in attendance at all times. No person under the age of 16 shall be allowed inside the stand nor will they be allowed to sell fireworks.

8. Highly combustible materials shall not be placed within or attached to the stand. Printed signs constructed of cardboard or heavy paper material may be attached to the exterior of the stand if such sign is firmly affixed to the stand.

9. When not in use, the retail stand shall be locked or otherwise secured.

10. A “No Parking” area shall be roped or barricaded off at a distance of 25 feet entirely around the stand.

11. The discharge of fireworks is prohibited within a distance of 100 feet from a fireworks stand.

C. Application for Fireworks Stand Permit.

1. The applicant shall provide the name and address for the agency responsible for the stand, and street address of the proposed sales stand, and name and address of the distributor or wholesaler.

2. The applicant shall attach a copy of a letter notifying the chief of the fire department of the fire protection district in which there is to be a retail sales stand stating the place of sale, storage, and the time during which activity shall be conducted. This letter must be directed by certified or registered mail to the fire chief and the returned receipt must be attached to a copy of the letter.

3. The applicant shall provide the original of the public liability insurance and property damage insurance policy in the following amounts: not less than $300,000 for the injury or death of one or more persons in any one accident or occurrence and not less than $100,000 for damage to property in any one accident or occurrence. It must be stamped and signed by the prosecuting attorney’s office.

4. The applicant shall attach a copy of the application for retail fireworks license previously approved by the State Fire Marshal.

5. The applicant shall provide a plot plan, drawn to a scale of one inch equals 50 feet, showing the location of the fireworks stand, other structures, driveways, parking areas and traffic paths on the property approved for use.

6. The applicant shall provide a cash bond to the city in the amount of $300.00 accompanying the application to ensure that the temporary fireworks stand shall be dismantled and removed from the premises within 10 days after the expiration of the retail sales license. After removal of said stand, the $300.00 cash bond shall be returned to the licensee.

7. The applicant shall, at time of permit request, submit a fee of $50.00, for review and issuance of the required permits. (Ord. 845 § 2, 2007. Formerly 15.04.010(C)(2))
