17.04.010 Title.

This title shall be referred to as the subdivision regulations of the city. (Ord. 681 § 2, 1996)

17.04.020 Policy.

It is hereby declared to be the policy of the city of Deer Park to consider the subdivision of land as the first step of community development.

Once land has been developed into streets, lots, blocks and publicly recorded, the correction of defects is costly and difficult. Subdivision of land sooner or later becomes a public responsibility in that properly constructed roads and streets must be maintained and various public services customary to urban areas must be provided. The welfare of the entire community is thereby affected in many important aspects. It is therefore in the interest of the public, the developer and future owners that any subdivision be conceived, designed, and developed in accordance with sound rules and proper standards. 17.04.030 Purpose.

A. The purpose of these regulations is to protect and promote the public health, safety, and general welfare of the city’s population, and to help insure the orderly development of the city consistent with the comprehensive plan through proper subdivision of land and street layout and to thereby implement such plan. The regulations of this title are established to implement state laws referring to the platting division of land and/or the dedication of lands, including but not limited to RCW Title 58, Chapters 36.70 and 65.08 RCW, and shall not preclude full compliance thereto.

B. These regulations are deemed reasonable and necessary to accomplish the purpose stated in subsection A of this section, and are designed, among other things, to provide for:

1. Proper arrangement of roads and streets in relation to existing or proposed roads and streets;

2. Adequate, useful and convenient open spaces;

3. Efficient movement of vehicular, pedestrian, and other modes of transportation;

4. Adequate and properly placed utilities;

5. Access for fire fighting apparatus;

6. Adequate recreation space, light and air;

7. Avoidance of population congestion;

8. Orderly and efficient layout and use of the land in light of the constantly changing conditions;

9. Accurate surveying of land. (Ord. 681 § 2, 1996)

17.04.040 Scope and jurisdiction.

A. This title governs all subdivisions within the city of Deer Park. Except as otherwise provided by law, this title governs subdivisions of land owned by the federal government, the state and its agencies and the municipality in the same manner as it governs subdivisions of land owned by private persons.

B. Effective Date. The provisions of this title shall not apply to any subdivision application which has received preliminary plat approval by the planning commission prior to March 13, 1996, under existing subdivision regulations. All other applications under this title shall be governed by the provisions of this title. (Ord. 681 § 2, 1996)
