18.04.010 Title.

This title shall consist of this text and the official zoning map and together shall be known and may be cited as the Deer Park zoning ordinance. The official zoning map will be designated by affixing the date, the city seal, and the signature of the city clerk. The map will be maintained and kept in the Deer Park planning department. 18.04.020 Purpose.

It is the purpose of this title to promote the health, safety and general welfare by guiding the development of the city by means of a comprehensive land use plan. It classifies land within the city into various zones, each with appropriate zone designations, and limits the nature of buildings and structures on such land. It intends to provide regulations and standards which will encourage high quality of development, prevent the overcrowding of land, provide adequate light and air, avoid excessive concentration of population, secure safety from fire and other dangers, lessen congestion on the streets, and facilitate adequate provisions for transportation, utilities, schools, parks and other public requirements on land throughout the city, which will promote and protect the economic stability of land and building values. 18.04.030 Interpretation and application.

A. The provisions of this title shall be held to be minimum requirements for promotion of the health, safety and general welfare of the public. Therefore, where this title imposes a greater restriction upon the use of buildings or premises, or upon the height of buildings, or requires larger open spaces than are imposed or required by other laws, ordinances, codes, easements, regulations or covenants, the provisions of this title shall control.

B. Nothing in this title shall be interpreted as permitting violation of or noncompliance with the regulations herein or any change whatsoever which would further violate these regulations or intensify an existing substandard or noncondition.

C. The text of this title shall be administered, interpreted, and enforced in accordance with the official zoning map.

D. Requests for rulings and interpretations as to the meaning, intent, or proper general applications of the ordinance to development and use of land or structures shall be made in written form by any interested citizen or public official. The director of planning shall submit a ruling or interpretation in writing and in a timely fashion to the person submitting the request.

E. In case of any questions as to the location of any boundary line between zoning classifications, a request for interpretation of the zoning map must be made in writing to the director of the planning department. A determination shall be made by the director, and the ruling or interpretation shall be submitted in writing to the person submitting the request. (Ord. 583 § 2, 1990; Ord. 394 § 2.6, 1981)

18.04.040 Resubmittal of applications.

No application administered under the authority of this title, which has been denied in whole or in part, shall be filed again within six months from the date of such denial, except upon proof of changed conditions or by written permission from the planning director. (Ord. 722 § 46, 1998)
