18.104.010 Nonconforming uses.

A. The lawful use of land, buildings or structures existing at the time of the adoption of the ordinance codified in this title, although such use does not conform to the provisions of such ordinance, may be continued. If such nonconforming use is abandoned for a period of six months or more, any further use of such land, building or structure must be in conformity with the provisions of this title. The mere presence of a building or structure shall not be deemed to constitute the continuance of a nonconforming use unless such structure is actually continuously occupied and used in the nonconforming manner.

B. A building or structure containing a nonconforming use shall not be enlarged or expanded nor shall the land area be expanded, unless the use of such building or structure is brought into conformance with the provisions of this title. Such use must also be in conformance for the zone in which such building or structure is located.

C. If any nonconforming building or structure is destroyed by fire, explosion, act of God, act of public enemy or any other cause to the extent that 50 percent of the fair market value as indicated by the records of the county assessor is lost, a future building, structure or land use at the site must be in strict conformance with the provisions of this title.
