12.30.010 Title.

This chapter shall be entitled “Transportation Benefit District.” [Ord. 1578 § 92, 2013.]

12.30.020 Application.

This chapter shall apply to all properties contained within a Transportation Benefit District formed pursuant to chapter 36.73 RCW. [Ord. 1578 § 93, 2013.]

12.30.030 Purpose.

The purpose of this chapter is to encourage and provide an alternative means to improve streets and walkways within the City. [Ord. 1578 § 94, 2013.]

12.30.040 Authority.

The chapter is created pursuant to provisions of chapter 36.73 RCW. [Ord. 1578 § 95, 2013.]

12.30.050 Establishing Transportation Benefit District.

There is created a Transportation Benefit District with geographical boundaries comprised of the corporate limits of the City as they currently exist or as they may exist following future annexations. [Ord. 1578 § 96, 2013.]

12.30.060 Governing board.

(1) The governing board of the Transportation Benefit District shall be the Des Moines City Council and it shall have the authority to exercise the statutory powers set forth in chapter 36.73 RCW and in this chapter.

(2) The treasurer shall be the City Finance Director.

(3) The City shall implement the material change policy previously adopted by the Des Moines Transportation Benefit District to address major plan changes that affect project delivery or the ability to finance the plan, pursuant to the requirements set forth in RCW 36.73.160(1).

(4) The City Council shall issue an annual report, pursuant to the requirements of RCW 36.73.160(2). The City Clerk shall file, maintain and make available for public inspection the annual report. [Ord. 1634 § 2, 2015: Ord. Ord. 1578 § 97, 2013.]

12.30.070 Transportation improvements funded.

The funds generated by the Transportation Benefit District shall be used for transportation improvements that preserve and maintain the transportation infrastructure of the City, consistent with the requirements of chapter 36.73 RCW, and shall be used primarily for improvements to preserve and maintain the City’s previous investments in the transportation infrastructure, reduce the risk of transportation facility failure, improve safety, continue the cost-effectiveness of the City’s infrastructure investments, and continue the optimal performance of the transportation system. 12.30.080 Establishment of vehicle license fee revenue source.

The City Council shall have the authority to establish an annual vehicle license fee in the amount of $40.00, consistent with RCW 36.73.065, to be collected by the Washington Department of Licensing on qualifying vehicles, set forth in RCW 82.80.140 and chapters 36.73 and 46.16 RCW. 12.30.090 Dissolution of district.

The benefit district shall be dissolved when all indebtedness of the district has been retired and when all of the District’s anticipated responsibilities have been satisfied. [Ord. 1578 § 100, 2013.]

12.30.100 Assumption of the Transportation Benefit District.

From and after November 17, 2015, the City of Des Moines assumes all of the rights, powers, immunities, functions, and obligations of the Des Moines Transportation Benefit District previously established in this chapter, and the City of Des Moines is hereby vested with each and every right, power, immunity, function, and obligation granted to or possessed by the Des Moines Transportation Benefit District under chapter 36.73 RCW, this chapter, and/or any other applicable law as of November 17, 2015. References to the rights, powers, functions and obligations previously exercised and/or performed by the governing body of the Des Moines Transportation Benefit District pursuant to this chapter are hereby assumed by and transferred to the Des Moines City Council.
