15.10.010 Land services director—Powers and duties.

The land services director shall enforce DCC Chapter 15.48 and is authorized to promulgate such rules, policies and/or procedures as may be deemed necessary to administer and enforce such regulations. 15.10.020 Building official—Powers and duties.

The building official shall enforce DCC Chapters 15.08 (except DCC Section 15.08.010(A)(4), International Fire Code), 15.12, 15.16, 15.20 and 15.32, and is authorized to promulgate such rules, policies and/or procedures as may be deemed necessary to administer and enforce such regulations. 15.10.030 Fire marshal—Powers and duties.

The fire marshal shall enforce DCC Section 15.08.010(A)(4), International Fire Code, and DCC Chapters 15.24 and 15.28, including but not limited to the following:

A.    Prevention of fires.

B.    Extinguishment of dangerous or hazardous fires.

C.    Storage, use and handling of hazardous materials.

D.    Installation and maintenance of automatic, manual and other private fire alarm systems and fire-extinguishing equipment.

E.    Maintenance and regulation of fire escapes.

F.    Maintenance of fire protection and the elimination of fire hazards on land and in buildings, structures and other property, including those under construction.

G.    Maintenance of exits.

H.    Investigation of the cause, origin and circumstances of fire and unauthorized releases of hazardous materials.

I.    Construction and maintenance of vehicular access for fire fighting apparatus and other emergency vehicles, except access to single-family residences and accessory structures on lots created prior to April 1, 1972, or created in accordance with DCC Section 17.04.020(B)(3).

15.10.040 Waiver of provisions.

In cases where the authorized official determines that compliance with the requirements of this title are impracticable due to impossibility or that such requirements do not readily apply to a specific set of circumstances, the authorized official may grant a limited waiver of such requirements. Any waiver shall conform to the intent and purpose of this title and be conditioned upon such requirements to protect health and safety. No waiver shall lessen fire protection requirements, any degree of structural integrity, or the health or safety requirements of this title or other applicable laws. (Res. TLS 04-41 Exh.
