17.18.010 Purpose.

The purpose of a binding site plan is to provide an alternative method for the division of land to create lots or tracts on land zoned for commercial or industrial use; to create lot or tracts for manufactured home parks or recreational vehicle parks; or to create lots or tracts for condominiums as authorized by RCW 58.17.035 and 58.17.040. 17.18.020 Applicability.

A.    The division of commercial or industrial zoned land for sale or lease when used for commercial or industrial purposes, or the division of land for lease when used as a manufactured home park or recreational vehicle park; and

B.    The division of land resulting from subjecting all or a portion of a parcel or tract to the Horizontal Property Regimes Act, Chapter 64.32 RCW, or the Condominium Act, Chapter 64.34 RCW. After approval of a binding site plan for land, all or a portion of which will be subjected to the provisions of Chapter 64.32 or 64.34 RCW.

C.    The site that is subject to the binding site plan shall consist of one or more contiguous lots.

D.    The site that is subject to the binding site plan may be reviewed independently for developed sites, concurrently with or subsequent to a development permit application for undeveloped land or concurrently with or subsequent to a building permit application.

E.    The binding site plan process creates or alters lot lines and does not authorize substantial improvements or changes to the property or the uses thereon. (Ord. TLS 17-12-44C Exh. A (part))

17.18.030 Application and approvals.

The application and approval of a preliminary binding site plan is prescribed in DCC Chapter 17.10. The application and approval of a final binding site plan is prescribed in DCC Chapter 17.14. (Ord. TLS 17-12-44C Exh. A (part))
