12.21.010 Application.

This chapter shall apply to any trail which may be found on public land, or within a public easement or right-of-way, within the town of Eatonville which does not meet the definition of a park as set forth in EMC 12.20.010. (Ord. 2016-10 § 2, 2016).

12.21.020 Methods of travel.

Trails shall be open to all nonmotorized users. Pedestrians, bicyclists and equestrians are permitted on all maintained soft surface pathways unless otherwise posted and designated. Trail restrictions may be posted at park entrances, trailheads, or along individual trails. (Ord. 2016-10 § 2, 2016).

12.21.030 Travel restrictions.

A. No person shall travel on a trail at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. In every event, speed shall be controlled as may be necessary to avoid colliding with others who are complying with the law and using reasonable care. Travel at speeds in excess of 10 miles per hour shall constitute prima facie evidence of a violation of this section.

B. No person shall travel on a trail in a negligent manner. Every person traveling on a trail shall obey the instructions of any official traffic control device applicable thereto unless otherwise directed by a police officer. (Ord. 2016-10 § 2, 2016).

12.21.040 Obstructions prohibited.

It shall be unlawful for any person to place, deposit, or otherwise cause or suffer to be located any structure, device, or natural or artificial thing that threatens or endangers any portion of a trail owned or maintained by the town, or that tends to endanger persons traveling thereon, obstructs or tends to obstruct or constitutes a hazard to persons traveling thereon. (Ord. 2016-10 § 2, 2016).

12.21.050 Application of general park rules.

General park rules and regulations as defined in Chapter 12.20 EMC shall apply to all trail users. (Ord. 2016-10 § 2, 2016).

12.21.060 Violations.

Violations of this chapter shall subject the person committing the violation to the abatement remedies set forth herein, as well as the following:

A. The first offense under this chapter shall be considered a class 2 civil infraction, punishable pursuant to Chapter 1.12 EMC;

B. The second offense under this chapter shall be considered a class 1 civil infraction, punishable pursuant to Chapter 1.12 EMC; and

C. The third offense, and any subsequent offense thereafter, shall be considered a misdemeanor. (Ord. 2017-08 § 1, 2017; Ord. 2016-10 § 2, 2016).
