1.10.010 General penalties.

Unless otherwise specified by the Edgewood Municipal Code (EMC), anyone who violates the provisions of any ordinance or this code shall be punished pursuant to the general penalty provision set forth below:

A. Misdemeanor Penalty. Unless otherwise provided, any person found guilty of violating any of the provisions of this code or failing to comply with any of the mandatory requirements of this code which is designated a misdemeanor shall be punished by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days, or by both such fine and imprisonment.

B. Gross Misdemeanor Penalty. Unless otherwise provided, any person found guilty of violating any provision of this code or failing to comply with any of the mandatory requirements of this code which is designated a gross misdemeanor shall be punished by a fine not to exceed $5,000 or by imprisonment not to exceed 364 days, or by both such fine and imprisonment.

C. Civil Infraction. Unless otherwise provided, any person violating any of the provisions of any ordinance or this code which is designated a class 1 civil infraction shall be assessed a monetary penalty not to exceed $250.00, not including statutory assessments, for each day that the violation occurs.

D. Civil Code Violation. Unless otherwise provided, all other civil violations of any of the provisions of any ordinance or this code not otherwise deemed a misdemeanor, gross misdemeanor, or civil infraction shall be subject to enforcement and penalties pursuant to EMC Title 7 and shall carry with it a cumulative monetary penalty of $250.00 for each day that the violation has occurred or is occurring. 1.10.020 Authority to issue civil infraction.

The administrator shall hereby have the authority to issue a civil infraction on behalf of the city for code violations designated as infractions in this code. (Ord. 23-658 § 1 (Exh. A)).

1.10.030 Chapter 7.80 RCW sections adopted by reference.

A. The following sections of the Revised Code of Washington (“RCW”) Chapter 7.80, as now or hereafter amended, are hereby adopted by reference as part of this title in all respects as though such sections were set forth herein in full: RCW 7.80.005, 7.80.010, 7.80.020, 7.80.030, 7.80.040, 7.80.050, 7.80.060, 7.80.080, 7.80.090, 7.80.100, 7.80.110, 7.80.120, 7.80.130, and 7.80.160.

B. The following sections of Chapter 7.80 RCW are excluded from the scope of subsection (A) of this section and are expressly not adopted by reference under this section: RCW 7.80.040, 7.80.140, 7.80.900, and 7.80.901. (Ord. 23-658 § 1 (Exh. A)).

1.10.040 Enforcement officer defined.

For purposes of this title and RCW 7.80.040, as now or hereafter amended, “enforcement officer” shall include the administrator, and his or her designee, as defined in EMC Title 7. (Ord. 23-658 § 1 (Exh. A)).

1.10.050 Separate offense.

Each and every day during any portion of which a violation is committed, continued or permitted is deemed a separate offense or violation. (Ord. 23-658 § 1 (Exh. A); Ord. 02-182 § 2. Formerly 1.10.020).

1.10.060 Nuisance.

In addition to the penalties set forth above, any condition maintained, caused, or permitted to exist in violation of any of the provisions of this code is a public nuisance, and all remedies given by law for the prevention and abatement of nuisances shall apply regardless of any other remedy.
