12.05.010 Authority to adopt interim road and rights-of-way code.

A. Pursuant to RCW 35.21.180, 35A.11.020, and 35A.21.160, and except as otherwise provided herein, the city adopts by reference PCC Title 12*, Roads and Rights-of-Way, as presently constituted or hereinafter amended, as the city’s interim roads and rights-of-way code.

B. The following provisions of PCC Title 12 are excluded from the scope of subsection (A) of this section and are expressly not adopted by reference under this section:

1. Chapter 12.20 PCC;

2. Chapter 12.32 PCC.

C. In accordance with RCW 35A.12.140, a copy of the regulations adopted by reference under this section shall be filed in the office of the city clerk, and shall be made available for use and examination by the public.

D. The following references as used in the PCC adopted under subsection (A) of this section shall have the following meanings for purposes of this title:

1. “Impact fee” shall mean the impact fees adopted pursuant to EMC Title 4, Impact Fees.

2. All other references to fees shall be the associated fees as set forth in the city of Edgewood fee schedule. (Ord. 23-652 § 22 (Exh. A); Ord. 16-465 § 1; Ord. 05-245 § 1; Ord. 96-16 § 1).

12.05.015 Vacation.

Repealed by Ord. 18-529. (Ord. 16-465 § 2).

12.05.020 Adoption of administrative rules.

There are further hereby adopted by reference any and all implementing administrative rules and enforcement remedies now in effect regarding PCC Title 12, Roads and Rights-of-Way, that have been adopted elsewhere in the Pierce County Code except that, unless the context requires otherwise, any reference to the “county” or to “Pierce County” shall refer to the city of Edgewood, and any reference to county staff shall refer to the mayor or designee. 12.05.030 Adoption of certain other laws.

To the extent that any provision of the Pierce County Code, or any other law, rule or regulation referenced in the attached roads and rights-of-way code is necessary or convenient to establish the validity, enforceability or interpretation of the attached roads and rights-of-way code, then such provision of the Pierce County Code, or other law, rule or regulation, is hereby adopted by reference. 12.05.040 Reference to hearing bodies.

To the extent that the attached roads and rights-of-way code refers to planning commissions, board of appeals, hearing examiner, or any other similar body, the city council shall serve in all such roles, but retains the right to establish any one or more of such bodies, at any time and without regard to whether any quasi-judicial or other matter is then pending.
