2.45.010 Establishment and maintenance.

The clerk-treasurer is authorized and directed to establish a fund which shall be characterized as an imprest fund. The moneys which may be from time-to-time maintained within such fund may, in such allocations as are deemed appropriate by the mayor, be maintained either as cash in the custody of the chief of police or in a checking account in such local bank as is determined to be appropriate. The funds to be placed in account are to be transferred from "General Fund--Unappropriated," into the account. (Ord. 878 §1, 1991).

2.45.020 Name of fund--Disbursement restrictions.

A.    The fund established pursuant to Section 2.45.010 of this chapter shall be denominated "City of Elma, Police Department--Criminal Investigations." Disbursements from the account shall be made only upon the authority and direction of the chief of police, subject to the approval of the mayor.

B.    Disbursements shall be made only for such purposes as are established by memorandum directive issued by the mayor. Such purposes may include, but are not limited to, provision of such funding as may be necessary to carry forth investigation of criminal activities, including but not limited to those involving controlled substances, the payment of informants, and the acquisition of capital assets for use by the police department. 2.45.030 Maximum amount of fund--Transfers to replenish money expended--Custodian.

A.    At no time shall the fund established pursuant to Section 2.45.010 of this chapter contain more than ten thousand dollars without the specific approval of the city council. The amount actually maintained in the fund shall be determined by the mayor, after consultation with the clerk-treasurer. At such time as disbursements are made from this fund and to the extent determined necessary by the mayor, the amounts expended shall be reimbursed to the fund from that certain fund within the budget denominated "law enforcement." At no time shall the disbursements from the fund exceed the funds available for reimbursement.

B.    In the event the mayor determines the funds from time to time within the fund exceed those reasonably necessary, then, to the extent allowed by law, those funds shall be subject to transfer to other funds or accounts within the city budget, including but not limited to those accounts or funds relating to the operation of the law enforcement agency of the city. To the extent such transfers may be carried out without the necessity of an ordinance, they may be carried out by the clerk-treasurer at the direction of the mayor with notification to the city council.

C.    At no time shall the amount of moneys in the fund and available for disbursement by the chief of police, who shall be deemed to be the custodian of the fund, exceed an amount equal to one month’s salary of the chief; provided, that in the event that there is a surety bond maintained covering the fiduciary responsibilities of the chief, then the maximum balance in the fund shall be the lesser of the amount of the surety or ten thousand dollars. 2.45.040 Recordkeeping requirements.

The chief of police shall at all times maintain such records as may be required by the clerk-treasurer and/or the Office of the State Auditor. (Ord. 878 §4, 1991).

2.45.050 Limitations.

The uses of the fund established pursuant to Section 2.45.010 of this chapter shall be limited to those specifications established by Section 2.45.030 of this chapter or by the mayor. (Ord. 878 §5, 1991).
