2.98.010 Established.

There is established an arts commission to promote and encourage public programs; to further the development and public awareness of and interest in the fine and performing arts; to facilitate the identification and preservation of the cultural heritage of the city, and to act in an advisory capacity to the city in connection with the artistic and cultural development of the city. (Ord. 941 §1, 1995).

2.98.020 Members.

A.    The arts commission shall consist of five members who shall serve three-year terms and who shall meet and possess the following qualifications, at the time of their appointment and at all times during their term:

1.    As to residence:

a.    Be residents of the city or;

b.    Be residents of unincorporated Grays Harbor County or Mason County and residing at a residence having an Elma mailing address, or residing east of the Satsop River at a residence having a Satsop mailing address; or

c.    Have such an interest in the cultural activities of the city as to merit inclusion upon the panel and be residents of eastern Grays Harbor County.

2.    Express and maintain an interest in the Elma arts commission and the provision of cultural opportunities and activities to the citizens of the city and the surrounding area.

B.    The five voting members of the board shall be appointed by the mayor and be subject to confirmation by the city council. They are subject to removal from the position by the city council either in the event they no longer possess the qualifications specified above, for such other grounds as may be the basis for the removal of a city council member during his or her term, or are absent from more than four consecutive meetings of the board without having been excused by the board.

C.    Vacancies upon the commission shall be filled for any unexpired term or completed term in the same manner as original appointments. (Ord. 955 §1, 1996: Ord. 941 §2, 1995).

2.98.030 Rules and procedures--Officers.

The commission shall organize, adopt administrative rules and procedures necessary to accomplish its purposes, and elect from its members such officers as it shall deem necessary. (Ord. 941 §3, 1995).

2.98.040 Duties and power.

The commission shall have the following duties and power:

A.    To hold regular public meetings and keep a written record of its proceedings which shall be a public record;

B.    To initiate, sponsor or conduct, alone or in cooperation with other public or private agencies, public programs to further the development and public awareness of, and interest in the fine and performing arts, and preservation of the cultural heritage of the city; provided, that no expenditure of municipal funds for any such activity shall be authorized or made without the prior approval of the city council;

C.    To seek and encourage donations and grants to the city for civic cultural purposes, including, but not limited to art and theater, to advise the city regarding the receipt of such donations and grants and transmit any funds so received to the city clerk-treasurer, and to recommend to the mayor and city council the purposes and amounts of expenditures of such funds;

D.    To advise the city concerning the receipt of or purchase of works of art to be placed on municipal property;

E.    To advise and assist the city in connection with such other artistic and heritage activities as may be referred to it by the city;

F.    To provide to the mayor and council an annual report summarizing its activities for the preceding twelvemonth period and making such budgetary requests and recommendations as it may deem necessary and appropriate to carry forth its activities and goals for the next budget year. This report shall be submitted prior to the first day of October of each calendar year to facilitate its consideration in the budgeting process of the city. (Ord. 941 §4, 1995).
