5.36.010 Definitions.

A.    For purposes of this chapter, the term "garage sale" means any event other than a sales activity operating in conjunction with a commercial or retail operation possessing an appropriately issued license from the city, which is advertised by any means whatsoever as a place or location at which members of the public may purchase identifiable or tangible personal property. The term garage sale shall include, by way of representation and not by way of limitation, yard sales, rummage sales, patio sales or other similar sales.

B.    "Year" means the calendar year commencing on the first day of January and terminating upon the thirty-first day of December. (Ord. 713 §1, 1980).

5.36.020 Number of garage sales allowed per year.

No individual, household, home address, group or family shall have more than two garage sales per calendar year. (Ord. 713 §2, 1980).

5.36.030 Requirements.

Any garage sale carried out within the corporate limits of the city shall fulfill the following requirements:

A.    Shall not exceed a period of offering or operation of more than two days;

B.    Goods shall be displayed only upon the individual’s property and not upon any public right-of-way or in any other manner which is inconsistent or in violation of any provision of any applicable ordinance of the city;

C.    Shall be conducted only between the hours of eight a.m. and eight p.m.;

E.    No signs advertising the sale shall be posted on any property other than that upon which the sale is being held or for which permission has been given for the posting of a sign; provided, that signs advertising the sale may be posted only during the duration of the sale and shall be removed by the individual so posting subsequent to the termination of the sale;

F.    All merchandise offered for sale shall be arranged so that the appropriate governmental officials including fire, police, health and other may have access for inspection at all times during the sale;

G.    Parking shall be so provided and regulated as to not allow or permit any parking by patrons or participants in the sale which would in any way violate the applicable traffic laws governing such parking matters or in any way block access to the area for emergency vehicles. 5.36.040 Violation--Penalty.

Any violation of this chapter is punishable as follows:

A.    Upon the first offense, by the issuance of a written warning with no criminal sanction being attached thereto;

B.    Upon conviction of a second and subsequent offense, by punishment in the manner provided by Section 1.28.010 of this code. (Ord. 713 §4, 1980).
