6.12.010 Definitions.

As used in this chapter, the specified terms shall have the following meanings:

A.    "Public highway" means any way, lane, road, street or avenue in every way or place in the city open as a matter of right to public vehicular traffic.

B.    "Roadway" means the paved, improved or proper portion of any public highway designated or ordinarily used for vehicular traffic, whether motorized or nonmotorized.

C.    "Sidewalk" means that property between the curb lines or the lateral lines for a roadway, as defined in this section, and the adjacent property, set aside for the use of pedestrians, or such portion of private property parallel and in proximity to a public highway, as defined in this section, and dedicated to use by pedestrians. 6.12.020 Not permitted on public highway or sidewalk--Exceptions.

No person shall ride, walk, or in any manner permit any horse to be in any public park or upon any public highway or sidewalk within the corporate limits of the city, provided that such animals may be permitted upon the public highways of the city to the extent allowed under any permit or approval issued by the city in relation to a parade related to or in support of the Grays Harbor District Fair or any other fair having similar certification from the state. (Ord. 610 §2, 1976).

6.12.030 Not permitted on private property without permission of owner.

No person shall ride, walk, or in any manner permit any horse to be upon any property within the corporate limits of the city without permission and consent of the owner or occupier of that property. (Ord. 610 §3, 1976).

6.12.040 Restricted areas--Violation and penalty.

A: No horses shall be allowed within the following described area, other than as provided by subsection B, unless they are contained within a trailer, a truck having appropriate bed for the transportation of livestock, or in some other vehicle designed for, capable of, or constructed for the transportation of livestock: An area having as its northern boundary Young Street to its intersection with First Street; thence southerly along First Street to the intersection of First Street with Waldrip; thence westerly along Waldrip to its intersection with Fifth Street; thence northerly along Fifth Street to its intersection with Young Street.

B.    Horses shall be allowed, other than while contained within or upon a transportational device, within the area specified in subsection A and on that certain portion of the streets of the city known as the Young Street Viaduct, commonly known as the "Old" Viaduct only under the following circumstances.

When they are present pursuant to and in relation to a parade or other activity related to any district fair, whether of an agricultural nature or otherwise, sponsored by the county of Grays Harbor, when such activity is authorized by action of the council of the city. The permit shall be issued upon such terms and conditions as may be established by the council.

C.    Horses shall be allowed in transit over the Young Street Viaduct, commonly known as the "Old" Viaduct, only under the same conditions as horses are allowed within the area specified in subsection A.

D.    So long as there are public streets running adjacent thereto, horses shall not be upon Main Street within the corporate limits of the city except as provided for transportation purposes in subsection A, provided that they shall be allowed to cross Main Street.

E.    Any person found to have violated the provisions of this chapter shall be subject to assessment as provided by Section 6.04.200. (Ord. 779 §4, 1984: Ord. 626 §§1--5, 1977).
