OFFENSE AGAINST PROPERTY--TRESPASS

9.24.010 Malicious mischief.

Any person who knowingly and maliciously causes physical damage to the property of another or who, for the purpose of annoyance or mischief, places in any doorway, sidewalk, street or alley within the city any box, barrel, barrier or other thing shall be guilty of malicious mischief. (Ord. 770 §2, 1984).

9.24.020 Criminal trespass--Unlawful.

Any person who knowingly enters or remains unlawfully in a building or knowingly enters or remains unlawfully in or upon the premises of another shall be guilty of criminal trespass. (Ord. 770 §3(A), 1984).

9.24.030 Criminal trespass--Defense.

It shall be a defense to a charge of criminal trespass that:

A.    The premises were, at the time, open to members of the public and the defendant complied with all lawful conditions imposed on access to or remaining in the premises; or

B.    The defendant reasonably believed that the owner of the premises, or other person empowered to license access thereto, would have licensed the defendant to enter or remain. (Ord. 770 §3(B), 1984).

9.24.040 Vehicle prowling.

A person who, with the intent to commit a crime against a person or property therein, enters or remains unlawfully in a vehicle, whether a motor home or otherwise, or a vessel equipped for propulsion by mechanical means or by sail, said vessel having a cab equipped with permanently installed sleeping quarters or cooking facility, shall be guilty of vehicle prowling. (Ord. 770 §3 (C), 1984).

9.24.050 Unlawful issuance of check or draft.

Any person who issues a check or a draft in an amount less than two hundred fifty dollars and who otherwise commits the act defined in Section 9.04.390 of this title, as now existing or hereafter amended, shall be deemed to have committed the offense of unlawful issuance of a check or draft and upon conviction thereof shall be subject to punishment as provided by Section 1.28.010 of this code. 9.24.060 Possession of stolen property.

Any person who commits the offense of possessing stolen property as that offense is defined by Section 9.04.270 of this title, as now existing or hereafter amended or supplanted shall, upon conviction, be punished as provided pursuant to Section 1.28.010 of this code. (Ord. 853 §3, 1989).

9.24.070 Illegal possession of vehicle.

Every person who, without the permission of the owner or person entitled to the possession thereof, intentionally takes or drives away any automobile or vehicle, whether propelled by electricity, internal combustion or by any other means, which is the property of another, and every person voluntarily riding in or upon said automobile or vehicle with knowledge of the fact that the same was unlawfully taken, shall be equally guilty with the person taking or driving said automobile or vehicle and, upon conviction, any such person shall be punished as provided in Section 1.28.010 of this code. 9.24.080 Theft.

Any person who commits the offense of theft as defined by Section 9.04.350 of this title, as now existing or hereafter amended or supplanted, shall, upon conviction, be punished as provided by Section 1.28.010 of this code. (Ord. 853 §6, 1989).
