9.32.010 Illegal purchase.

Any person who buys alcoholic beverages from any person other than the State Liquor Board, a state liquor store or some person authorized by the State Liquor Control Board to sell alcoholic beverages shall be guilty of the offense of buying liquor illegally. (Ord. 770 §8(A)(1), 1984).

9.32.020 Consumption in public place.

No person shall open the package containing liquor or consume liquor in a public place except as authorized pursuant to the provisions of RCW Title 66 as now existing or hereafter amended, including those situations which would be justified under RCW 66.44.160. (Ord. 770 §8(A)(2), 1984).

9.32.030 Possession, consumption by minors.

A.    No person shall sell, give or otherwise supply intoxicating liquor to any person under the age of twenty-one years or permit any person under that age to consume liquor on his or her premises or any premises under his or her control. For purposes of this section, premises, by way of example and not by way of limitation, shall include residences, apartments, meeting rooms, banquet halls and vehicles.

B.    No person under the age of twenty-one years shall possess, consume or have consumed or otherwise acquire any intoxicating liquor. For purposes of this subsection, a person shall be deemed to have consumed an intoxicating liquor if at the time of the contact with the officer, there are still indicia upon his or her person of such consumption, including but not limited to alcohol within the blood or odor of alcohol upon the breath.

C.    The prohibitions of subsections A and B of this section shall not apply to intoxicating liquors given or permitted to be given to a person under the age of twenty-one years under the following circumstances:

1.    By a parent or guardian and consumed in the presence of the parent or guardian. This subdivision shall not authorize consumption or possession of intoxicating liquor by a person under the age of twenty-one years on any premises licensed under RCW Chapter 66.24;

2.    To liquor given for medicinal purposes to a person under the age of twenty-one years by a parent, guardian, physician or dentist;

3.    To liquor given to a person under the age of twenty-one years when such liquor is being used in connection with religious services and the amount consumed is a minimum amount necessary for the religious service.

D.    Any person convicted of a violation of subsections A or B of this section shall be subject to punishment as provided by Section 1.28.010 of this code. (Ord. 853 §7, 1989: Ord. 770 §8(A)(3), 1984).

9.32.040 Violation of Section 9.32.030.

Any person who shall have violated the provisions of the first sentence of Section 9.32.030 shall be guilty of the offense of providing liquor to a minor. Any person violating the terms and provisions of the second sentence of Section 9.32.030 shall be guilty of the offense of minor in possession/consumption. (Ord. 770 §8(A)(4), 1984).

9.32.050 Unlawful purchase by minor.

Any person who, under the age of twenty-one years, purchases or attempts to purchase intoxicating liquor shall be guilty of the offense of purchasing liquor. (Ord. 770 §8(A)(5), 1984).
