PARKING INFRACTIONS

10.28.010 Bail required--Overtime parking--Violations other than overtime parking.

Any person who shall be issued a notice of parking infraction by the officers of the Elma police department shall, upon issuance of the citation, post the following bail with the traffic violations bureau of the Elma police department:

A.    Overtime Parking.

1.    Within two hours of the time of issuance of the notice, two dollars;

2.    Within twenty-four hours of the issuance of the notice five dollars;

3.    Within seven days of the date of issuance, ten dollars;

B.    As to any violations of the parking provisions of the model traffic ordinance, as the same shall be in effect from time to time in the city, excepting overtime parking, the bail shall be as established from time to time by the court rules covering such matters promulgated by the Supreme Court of the state of Washington for parking violations and similar violations for which bail is not otherwise established by city ordinance or court rule. 10.28.020 Failure to post bail--Penalty assessment.

In the event that a person who has been issued a notice of parking infraction does not, within the seven-day period provided for in Section 10.28.010, either post the bail required by subsections A or B of Section 10.28.010 or give notice of a request for hearing upon the matter, whether said hearing be to contest the issuance or to mitigate the penalty, the person, in addition to any other penalty which may be imposed, shall regardless, have imposed upon them a penalty assessment of twenty-five dollars as provided by RCW Chapter 46.63 Laws of 1982.
