POTABLE WATER REQUIRED FOR HABITATION

13.28.010 Harm results when.

The council finds that the public health and safety is harmed by the habitation of premises within the city when they are not being currently provided water to the premises by the municipal water system and approved on-site well or an improved community system. This harm results from a number of factors including but not limited to the practical unavailability of appropriate sewage disposal. (Ord. 818 §28(part), 1987).

13.28.020 Habitation--Allowed when--Deemed nuisance when.

No premises shall be utilized for human habitation unless it has available and is utilizing potable water from the municipal water system or an approved on-site well or community water system. Any residence or structure within the corporate limits being utilized contrary to the provisions of this section shall be deemed to be a public hazard and nuisance and the building official shall take such steps as are necessary to prevent and prohibit occupation of the structure or residence until the water service is available and utilized. (Ord. 838 §28(part), 1987).

13.28.030 Violation--Penalty.

It is unlawful for any person to occupy a residence or structure within the corporate limits at such time as it is in violation of the provisions of Section 13.28.020. Any person convicted of a violation of this chapter shall be subject to punishment as provided in Section 1.28.010. (Ord. 838 §28(part), 1987).
