5.10.010 Definitions.

For the purpose of this chapter, the term “garage sale” shall include yard sales, patio sales, rummage sales, or other similar sales of 20 or more miscellaneous new and used items, and which is advertised for the general public to attend. This definition is not meant to include new handcrafted items by the sponsor of the sale. (Ord. 508 § 1, 1996)

5.10.020 Restrictions.

(1) There shall not be conducted more than four garage sales at any one location during a calendar year. The length of time for each garage sale shall not exceed three consecutive days. Goods displayed in any garage sale may not be displayed in the public right-of-way.

(2) Signs advertising such sales shall not be attached to any public structures, signs, traffic-control devices, or to any utility poles.

(3) All advertising signs shall not exceed four square feet in size. All such signs shall be removed within 24 hours after the sale is completed. (Ord. 508 § 2, 1996)

5.10.030 Violation – Penalty.

Any person found to be in violation of this chapter shall be fined the sum of not less than $25.00 and not more than $250.00 per violation. Each day the violation continues shall be considered a separate violation. Any person violating the provisions of this chapter shall have committed an infraction and a penalty shall be imposed based on the following penalty schedule:

(1) Every person who is convicted of a violation of this section shall be punished by a monetary penalty of $25.00.

(2) On a second conviction for a violation of this chapter within a one-year period, a person shall be punished by a monetary penalty of $50.00.

(3) On a third conviction for a violation of this chapter within a one-year period, a person shall be punished by a monetary penalty of $100.00.

(4) On a fourth or subsequent conviction for a violation of this chapter within a one-year period, a person shall be punished by a monetary penalty of $250.00. (Ord. 508 § 3, 1996)
