9.05.010 Purpose.

This chapter is enacted to protect the safety of persons and properties traveling on the public highways and living within areas near urban centers. (Ord. 748 § 1, 2014; Ord. 639 § 2, 2005; Ord. 603 § 1, 2003)

9.05.015 Firearms – Defined.

For the purposes of this chapter, a firearm is defined as a weapon or device from which a projectile or projectiles may be fired by gunpowder (RCW 9.41.010(7)).

Orchard cannons and air guns as commonly used by orchardists to scare off birds and wildlife are not considered firearms for the purpose of this chapter. (Ord. 748 § 1, 2014)

9.05.020 Discharging firearms – Unlawful.

(1) It is unlawful for any person to point or shoot a firearm (or to point a firearm at any person) within the city limits of Entiat.

(2) Subsection (1) of this section shall not apply in the following instances:

(a) Any lawful act committed by a person while in his place of residence or fixed place of business;

(b) Any person who by virtue of his office or public employment is vested by law with a duty to preserve public safety, maintain public order, or to make arrests for offenses, while in the performance of such duty whether during regular duty hours or not;

(c) Any person acting for the purpose of protecting himself against the use of presently threatened unlawful force by another, or for the purpose of protecting another against the use of such unlawful force by a third person;

(d) Any person making or assisting in making a lawful arrest for the commission of a felony;

(e) Any person defending himself, another person, pets or livestock, or private property from wildlife. (Ord. 748 § 1, 2014; Ord. 639 § 2, 2005)

9.05.030 Specific restricted areas.

This section applies to the Entiat city limits as defined by the most current comprehensive plan and zoning map. (Ord. 748 § 1, 2014; Ord. 639 § 2, 2005; Ord. 603 § 2, 2003)

9.05.040 Violation – Penalty.

Any person violating any provision of this chapter shall be guilty of an infraction and punishable by a fine as follows: the first offense – $100.00, second offense – $250.00, and third offense – $500.00. (Ord. 748 § 1, 2014; Ord. 639 § 2, 2005; Ord. 603 § 3, 2003)
