12.20.010 Applicability.

This chapter constitutes the general regulations which will be in effect for all city parks and for all other property under the management of the department of public works; other property includes but is not limited to property commonly known as the “greenways,” “city and/or LINK park and ride lot,” “rights-of-way and associated shoulders,” “city parking lots” or “open space and trails.” (Ord. 840 § 1, 2022; Ord. 797 § 1 (Exh. 12.20.020 Regulations issued by the director of public works.

(1) The director of public works is authorized to issue regulations for the use of park property, facilities, and equipment.

(2) The city assumes no liability for the condition of the property subject to the regulations, for the adequacy of the regulations, or for the failure to enforce them.

(3) Parks facilities are available for public use whenever possible, without conflicting with city programs.

(4) Reservations or scheduling for use of the Entiat city park (Will Risk Memorial Park) is done by using the current internet-based reservation site.

(5) Reservations for all other city-owned property are done through the Entiat City Hall.

(6) User fees may be required for certain major park facilities such as athletic fields, park shelters, and indoor facilities. These fees are set, from time to time, by council resolution. (Ord. 797 § 1 (Exh. A), 2019)

12.20.030 Park scheduling.

(1) All city parks shall be open from dawn to dusk, unless otherwise posted or authorized to be open with a permit or reservation.

(2) A violation of this section is a Class 2 civil infraction. (Ord. 842 § 1, 2022; Ord. 797 § 1 (Exh. A), 2019)

12.20.040 Motor vehicle operation and parking.

(1) The speed limit for all vehicles within city parks is 15 miles per hour unless otherwise posted by the public works director.

(2) Motor vehicles shall be operated only on paved roadways and shall be parked only in designated paved or graveled parking areas. “Paved roadways” as used in this subsection does not include paved ways marked for the exclusive use of pedestrians, bicycles, or wheelchairs.

(3) Parking spaces within city parks are reserved for the use of park patrons during open park hours; parking during closed park hours and nonpatron parking on park property are prohibited.

12.20.050 Bicycle operation.

(1) Bicycles may only be operated on designated paved and graveled ways and established trails within park property.

(2) Bicycle riding is not permitted on nondesignated locations.

12.20.060 Restrictions on animals in parks.

(1) All dogs must be under control by means of a leash. This requirement does not apply to areas of park property that are signed and designated for dog exercise and training.

(2) Horses are only allowed on paved roads open to motor vehicles.

(3) Owners or handlers are responsible for cleaning up their animals’ waste deposits left on park property.

(4) Owners and handlers are required to have in their possession the equipment necessary to remove their animals’ fecal matter when accompanied by said animal.

(5) Except for fishing, no person shall hunt, catch, or injure any wild animal or bird on park property.

12.20.070 Overnight camping.

(1) Overnight camping is prohibited on park property except by reservation or written permission and accompanied by the necessary fees and in locations designated for such use.

12.20.080 Campfires.

(1) Campfires are prohibited on park property except in those locations designated for such use. All campfires may be prohibited for safety purposes at the discretion of the public works director.

12.20.090 Litter in parks.

(1) No person shall throw or deposit litter on any park property, except in public receptacles and in such a manner that the litter will be prevented from being carried or deposited by the elements upon any part of the park, or upon any street or other public place. Where public receptacles are not provided, all litter shall be carried away and properly disposed of.

(2) No person shall use the park litter receptacles in the following manner:

(a) No person shall damage, deface, abuse, or misuse any litter receptacle so as to interfere with its proper function or detract from its proper appearance.

(b) No person shall deposit leaves, clippings, prunings, or gardening refuse in any litter receptacle.

(c) No person shall deposit household garbage in any litter receptacle; provided, that this subsection shall not be construed to mean that wastes of food consumed on park property may not be deposited in litter receptacles.

(3) Whenever litter dumped in violation of this chapter contains three or more items bearing the name of one individual, there shall be a rebuttable presumption that the individual whose name appears on such items committed the unlawful act of littering.

(4) For purposes of this section, “litter” means garbage, refuse, rubbish, or any other waste material which, if thrown or deposited as prohibited in this section, tends to create a nuisance which annoys, injures, or endangers the health, safety, or comfort of the public.

12.20.100 Sales/rentals – Prohibited.

(1) The sale of food, drink, other merchandise, or any services on park property is prohibited, unless the seller has a vendor/concession sales contract with the city.

(2) The rental of any merchandise or materials on park property is prohibited, unless the renter has a vendor/concession contract with the city.

12.20.110 Sign posting prohibited.

(1) It is unlawful to place or erect any signboard, sign, advertising, decoration, or similar structure on any park property, without the written permission of the director of public works.

12.20.120 Restricted areas – Generally.

(1) It is unlawful for any person except a city employee in the performance of his or her duties, or other person authorized by law, to enter or go upon any area which has been designated as a “no admittance” or “closed to use” or “no trespassing” area for the purpose of protecting park property or for protecting the public from conditions which constitute a potential hazard.

(2) It is unlawful for any person to engage in any activity that has been deemed potentially hazardous to public safety or park property, or incompatible with park property usage as designated and posted by the director of public works.

12.20.140 Removal or destruction of park property.

(1) It is unlawful for any person to remove, injure, deface, damage, or destroy park property. This prohibition applies to all aspects of the natural or landscaped environment and to any structure, object, equipment, improvement, or other park property.

(2) It is unlawful to collect, gather, or harvest natural resources or other materials on park property except by written permission of the director of public works.

(3) A violation of this section is a Class 2 civil infraction. (Ord. 797 § 1 (Exh. A), 2019)

12.20.150 Encroachments on park property.

(1) It is unlawful for any person other than an authorized employee or agent of the city to do any of the following acts without the written permission of the director of public works:

(a) Place, erect, or maintain any structure or obstruction of any kind on park property;

(b) Deposit or store any refuse, debris, vegetation, personal property, litter, or any other material on park property;

(c) Mow, prune, cut, clear, plant on, or otherwise alter or disturb any park property.

12.20.160 Authority to issue civil infraction.

The director of public works, or his/her designee, shall hereby have the authority to issue a civil infraction on behalf of the city for violations of the Entiat city code that shall be punishable pursuant to this chapter. (Ord. 797 § 1 (Exh. A), 2019)

12.20.170 Chapter 7.80 RCW sections adopted by reference.

The following sections of the Revised Code of Washington (“RCW”), as now or hereafter amended, are hereby adopted by reference as part of this chapter in all respects as though such sections were set forth herein in full: RCW 7.80.005, 7.80.010, 7.80.020, 7.80.030, 7.80.040, 7.80.050, 7.80.060, 7.80.080, 7.80.090, 7.80.100, 7.80.110, 7.80.120, 7.80.130, and 7.80.160. 12.20.180 “Enforcement officer” defined.

For purposes of this chapter and RCW 7.80.040, as now or hereafter amended, “enforcement officer” shall include the city’s director of public works, or his or her designee or Chelan County sheriff, or his or her designee. (Ord. 840 § 2, 2022; Ord. 797 § 1 (Exh. A), 2019)

12.20.190 Repeat violation.

A repeat violation shall be a Class 1 civil infraction. (Ord. 797 § 1 (Exh. A), 2019)
