5.16.010 CATV rate regulation – Adoption of Federal acts and regulations by reference.

The City of Everson hereby adopts by reference the Cable Television Consumer Protection and Competition Act of 1992, codified in 47 U.S.C. Title VI, and the regulations promulgated by the Federal Communications Commission (FCC) pursuant thereto in 47 C.F.R. Part 76, as amended from time to time, as and for the CATV regulations of the City of Everson. [Ord. 466 § 1, 1994.]

5.16.020 CATV rate regulation – Responsible official.

The Mayor of the City of Everson, or his designee, is responsible for the efficient and orderly enforcement of the CATV regulations of the City of Everson. [Ord. 466 § 2, 1994.]

5.16.030 CATV rate regulation – Authorization for interlocal cooperation and/or delegation of enforcement authority.

Notwithstanding the provisions of EMC 5.16.020, the City Council may by interlocal agreement with Whatcom County or one or more other cities situated therein provide for uniform and coordinated CATV rate regulation, and include appropriate delegations of enforcement authority thereby. 5.16.040 CATV rate regulation – Violations as civil infractions.

Each violation of the acts and regulations adopted by reference in EMC 5.16.010 shall be a civil infraction, with a monetary penalty not in excess of criminal jurisdiction to be determined by the Everson Municipal Court Judge for each such infraction. Each day that a violation occurs or continues shall be a separate infraction. [Ord. 466 § 4, 1994.]
