19.15.010 Land use zones established.

In order to classify, segregate and regulate the uses of land, buildings and structures, the City of Everson is hereby divided into the following land use zones:

19.15.020 Official zoning map.

The official zoning map shall be the final authority as to the current zoning status of any particular parcel of land in the City, as follows:

A. The Everson zoning ordinance shall consist of EMC Title 19 together with that certain zoning map designated as “The Official Zoning Map of the City of Everson.” If any conflict between the map and the text of the Everson zoning ordinance is deemed to arise, the text shall prevail.

B. If zoning amendments are hereafter made in zone boundaries, designations or the matters portrayed on the official zoning map, such changes shall be made on the map at the direction of the City Council, and certified by the Clerk.

C. All land hereafter annexed to the City of Everson shall automatically receive the zoning use designation assigned thereto in the comprehensive plan.

D. If land is not designated in any specified zone, either through oversight or intention, it shall be deemed to carry to the designation of that adjoining property having the least intensive use.

E. The official zoning map shall be filed with and certified by the City Clerk and the same, or a copy thereof, shall be permanently displayed in the City Hall. [Ord. 517 § 1, 1997; Ord. 282 § 3, 1983.]

19.15.030 Rules of construction.

In the event of uncertainty as to boundaries of any land use zone shown on the official zoning map, the following rules of construction shall apply:

A. Where zone boundaries are indicated as following streets, alleys or highways, the actual centerline shall be construed to be the boundary.

B. Where zone boundaries are indicated as running parallel to any street, the boundary line shall be construed to be parallel to the centerline of the street.

C. Where zone boundaries are indicated as following the lot or tract lines, the actual lot or tract lines shall be construed to be the boundaries of such zone.

D. Where a zone boundary divides a tract in unsubdivided property, the location of such zone boundary, unless the same is indicated by dimensions thereon, shall be determined by use of the scale appearing on the official zoning map.

E. Where zone boundaries are indicated as following shorelines and a change occurs in the shoreline, the same shall be construed as moving with the actual shoreline. [Ord. 517 § 2, 1997; Ord. 282 § 3, 1983.]

19.15.040 Scope of regulations.

Except as otherwise provided in the Everson zoning code:

A. No building or structure shall be erected and no existing buildings or structures shall be moved, altered, added to or enlarged, nor shall any land, building or structure or premises be used, designed or intended to be used for any purpose or any manner other than the use permitted in the zone in which such land, building, structure or premise is located.

B. No building or structure shall be erected nor shall any existing building or structure be moved, reconstructed or structurally altered, inconsistent with or in violation of the size and construction standards established for the zone in which such building or structure is located.
