2.25.010 Creation of department.

There is hereby created a city department known as the Federal Way police department (“department”), whose duties and responsibilities shall include: enforce criminal laws and civil infractions; investigate crimes and refer for prosecution, educate the community on enforcement practices and crime prevention, work collaboratively to identify crime trends and implement solutions to reduce crime, provide proactive services and security to community, participate in the local, state, and federal criminal justice and national security systems, administer animal services, including licensing.

2.25.020 Police chief – Appointment and confirmation.

There is hereby created the position of police chief. The mayor shall appoint a chief of police, subject to confirmation by a majority of the city council. The position of chief of police shall be exempt from the civil service system.

2.25.030 Police chief – Duties.

The police chief shall be responsible for directing the city’s community-oriented policing organization including facilitating citizen and business involvement; assuring the prevention of crime and protection of property and life through the enforcement of state, county, and municipal laws and ordinances; providing advice and counsel to city officials regarding law enforcement; and supervising law enforcement staff.

2.25.040 Police chief – Qualifications.

The police chief shall have any combination equivalent to a bachelor’s degree in law enforcement, public administration or related field and ten years’ increasingly responsible and varied administrative experience in a qualified federal, state, county or municipal law enforcement agency including at least five years’ supervisory experience.

2.25.050 Warrant officers.

(1) The position of warrant officer is hereby established in the Federal Way police department, as authorized by RCW 35A.21.380. Warrant officers shall have special limited authority as provided for in this section and as assigned by the chief of police.

(2) The Federal Way police department is authorized to employ up to 10 warrant officers, when authorized by the city’s biannual budget.

(3) To be minimally qualified for the position of warrant officer, the applicant shall:

(a) Be at least 21 years of age;

(b) Have any combination equivalent to graduation from high school and at least two years of employment history;

(c) Satisfactorily complete a Federal Way police department background investigation which includes but is not limited to a polygraph examination, criminal convictions records check, medical evaluation, drug screening, and a psychological exam;

(d) Obtain and maintain a valid Washington State driver’s license within 30 days of employment;

(e) Obtain and maintain a valid Washington State license to carry a concealed pistol within 90 days of employment;

(f) Maintain regular, reliable, and punctual attendance at work;

(g) Have the ability to do the following:

(i) Prepare clear and accurate reports and logs;

(ii) Use Microsoft Word, Excel, Access, and the internet;

(iii) Testify in court regarding relevant job-related incidents;

(iv) Work evenings and holidays;

(v) Endure verbal abuse when confronted with hostile views and opinion of others, including arrestees;

(vi) Treat all individuals with respect and courtesy regardless of race, color, or national origin, while setting and enforcing limits on appropriate behavior for persons in custody;

(vii) Enforce Federal Way police department policies and procedures and applicable laws;

(viii) Safely and legally operate city vehicles;

(ix) Safely operate, carry, use, and care for firearms and other defensive tools issued by the Federal Way police department;

(x) Work effectively in indoor and outdoor environments;

(xi) Perform heavy work, exerting up to 100 pounds of force occasionally, up to 50 pounds of force frequently, and up to 20 pounds of force constantly to move objects; and

(xii) Participate in training prescribed by the chief of police for the position of warrant officer.

(4) When authorized by the chief of police, warrant officers shall the have special limited authority to:

(a) Transport arrested persons or persons who are in the custodial jurisdiction of the Federal Way police department or the Federal Way municipal court;

(b) Extradite and transport prisoners;

(c) Book arrested persons into federal, state, county, and local detention facilities;

(d) Make arrests authorized by criminal warrants;

(e) Arrest a criminally accused person appearing in court as directed by a judge (perform remand arrests for the court);

(f) Serve civil and criminal court orders and subpoenas, including but not limited to protection orders, no contact orders, restraining orders, and anti-harassment orders;

(g) Perform physical searches of arrested or transported people;

(h) Assist law enforcement officers at scenes by providing traffic control or other supportive duties as assigned;

(i) Assist in the city’s emergency response to manmade and natural disasters;

(j) When requested by a police supervisor, respond to calls of a noncriminal nature, including stalled vehicles, road hazards, lost children, and wandering persons with dementia;

(k) When requested by a police supervisor, obtain saliva DNA samples from a person as ordered by a court;

(l) Provide courier services for the city upon direction of the chief of police;

(m) Provide security duties for the Federal Way municipal court;

(n) Investigate parking complaints and issue notices of infraction for parking violations;

(o) Investigate apparently abandoned vehicles and impound such as prescribed by law for Washington peace officers;

(p) Compose reports documenting incidents related to job duties;

(q) Protect themselves and others in their immediate vicinity from violence;

(r) Perform all duties while armed; and

(s) Perform all duties ancillary to the aforementioned authority.

(5) Training requirements for warrant officers shall be established by the Federal Way chief of police and approved by the Washington State Criminal Justice Training Commission.

(6) Warrant officers shall not be entitled to death, disability, or retirement benefits pursuant to Chapter 41.26 RCW on the basis of service as a warrant officer as described in this section.
