2.19.010 Position created.

There is created the office of the Public Works Director. The position will be filled by appointment of the Mayor, subject to confirmation by the City Council, to serve at the pleasure of the Mayor and at the discretion of the Mayor. The City at its discretion may specify additional terms and conditions of employment in a written agreement executed by the Mayor and approved by the City Council. (Ord. 2178 § 1 (Att. 1), 2021)

2.19.020 Scope of authority.

Under the direction and authority of the Mayor and the City Administrator, the Public Works Director shall be responsible for FMC Titles 12, 13, and 19 and shall have the authority to act on:

A.    Administrative Interpretations. Under FMC 14.05.025, the Public Works Director is vested with the authority to interpret the meaning of the provisions of FMC Titles 12, 13, and 19 as required to reasonably administer said provisions on a day-to-day basis. In addition, any citizen may request a formal interpretation of these code provisions by submitting a written request to the Public Works Director. Upon the submission of a formal code interpretation, the Public Works Director shall interpret the meaning or application of the provisions of said titles and issue a written administrative interpretation within 30 days. Formal written requests for code interpretation shall concisely identify the issue and desired interpretation.

B.    Administrative Decisions. Administrative decisions as set forth in Chapter 14.09 FMC, except those noted as requiring approval of the Community Development Director.

C.    Capital Facilities. The Public Works Director shall be responsible for overseeing the construction, maintenance, and operation of the City’s capital facilities projects, as well as City facilities and structures.

D.    Infrastructure. The Public Works Director shall be responsible for the maintenance and operation of the City’s built infrastructure, transportation, and utility conveyance systems.

E.    City Utilities. The Public Works Director shall be responsible for the maintenance and operation of the City’s water and sewer treatment plants, distribution system, and water source(s). (Ord. 2178 § 1 (Att. 1), 2021)

2.19.030 General powers and duties.

A.    Under the direction and authority of the Mayor and City Administrator, the Public Works Director shall act in the following roles and may be referred to as such, and shall have the powers and duties assigned to each. The title “Public Works Director” shall include the following titles, unless otherwise stated or hereinafter amended:

B.    Providing relevant information and advice to the Mayor, City Administrator, City Council, other public officials and the public on the operations and administration of the roles assigned to the Public Works Director.

C.    Performing such other duties as the Mayor and City Administrator may determine by ordinance or resolution. (Ord. 2178 § 1 (Att. 1), 2021)
