12.45.010 Adoption of document.

The “Friday Harbor Tree Care Standards,” as are adopted by town resolution, are hereby established as the standards to be adhered to for planting, maintenance and management of public trees located in the public right-of-way, parks and town property. (Ord. 1617 § 2, 2017)

12.45.020 Copies on file.

The publication entitled “Friday Harbor Tree Care Standards” shall be available for review in the office of the town clerk. (Ord. 1617 § 2, 2017)

12.45.030 Applicability.

A. Nothing in the chapter shall interfere, alter or in any way change the responsibility of the planning and community development department or public works department concerning trees relative to planning for the urban design of the town or implementation of street standards and utilities.

B. It is intended that this chapter will avoid any inconsistencies with various laws and ordinances of the town including the application of environmental or critical areas regulations as set forth now or amended.

C. If and where any conflicts may exist between tree installation and maintenance policies or other provisions of this policy and critical areas or development regulations, the critical areas or development regulations shall be controlling. (Ord. 1617 § 2, 2017)

12.45.040 Administrator.

The town administrator or his designee shall administer the provisions of this chapter. (Ord. 1617 § 2, 2017)

12.45.050 Arbor Day participation.

The mayor shall provide for a proclamation for the annual observance of Arbor Day in the town of Friday Harbor. (Ord. 1617 § 2, 2017)

12.45.060 Violation and enforcement.

A violation of this chapter is declared a public nuisance and a Class 1 civil infraction, as defined and addressed in Chapter 1.18 FHMC, with each day a violation exists subject to treatment as a separate violation. (Ord. 1617 § 2, 2017)
