13.36.010 General provisions.

A. It is not intended that this chapter repeal, abrogate, or impair any existing regulations, easements, covenants, or deed restrictions. However, where this chapter imposes greater restrictions, the provisions of this chapter shall prevail.

B. The provisions of this chapter shall be held to be minimum requirements in their interpretation and application and shall be liberally construed to serve the purposes of this chapter. (Ord. 1038 § 3, 1997)

13.36.020 Adoption of document.

The “Town of Friday Harbor Storm Water Technical Manual” is hereby adopted as the conditions and construction standards to be adhered to in any and all land disturbing activities, structural development, and creation of any impervious surfaces. (Ord. 1038 § 4, 1997)

13.36.030 Copies on file.

The publication entitled “Town of Friday Harbor Storm Water Technical Manual” shall be available for review in the office of the town clerk. (Ord. 1038 § 5, 1997)

13.36.040 Approval required.

No person or any other entity shall commence any land disturbing activity, structural development, or creation of any impervious surfaces without first having fulfilled the requirements of this chapter. (Ord. 1038 § 6, 1997)

13.36.050 Fees.

The nonrefundable plan review fee shall be reviewed annually by the town council who shall direct the town clerk to adjust the fee appropriately and post said permit application fee in a conspicuous place within Town Hall and make such list available to the public upon request. (Ord. 1038 § 7, 1997)

13.36.060 Violation.

Land disturbing activity, structural development, or creation of any impervious surfaces in violation of any provision of this title shall be and hereby is declared both a public nuisance and a Class 1 civil infraction as defined in FHMC Title 1. (Ord. 1038 § 8, 1997)

13.36.070 Enforcement.

Except in circumstances where there is a serious and imminent threat to public health or safety, prior to filing a public nuisance abatement action in San Juan County superior court, the town shall attempt to gain compliance by use of the civil infraction procedures set forth in FHMC Title 1. 13.36.080 Penalty.

The penalty for committing a civil infraction under FHMC 13.36.010 shall be as set forth in FHMC Title 1. (Ord. 1038 § 10, 1997)
