5.06.010 Licenses required.

Any person, firm or corporation, within the corporate limits of the city keeping and operating one or more billiard tables, pool tables, or a bowling alley shall first procure a license and pay the license fee in the amount and in the manner provided in this chapter. The license provided for herein is in addition to the business license required in GMC 5.04.010. (Ord. 2008-27 § 2).

5.06.020 Application.

Any person desiring to obtain a license to open or conduct an establishment operating billiard or pool tables or bowling alleys shall make application to the city clerk who shall review the application and conduct any required inspections. The application shall particularly describe the premises wherein such business is to be conducted and carried on during the continuance of said license. In the event the license application is rejected by the city clerk, the city clerk shall provide notice of said rejection to the applicant in writing setting forth the reasons for such rejection and the applicant shall have the right to appeal such rejection under the appeal procedures set forth in Chapter 2.50 GMC. 5.06.030 Fees – Billiard and pool room – Penalty.

The fee for establishments other than nonprofit organizations operating any billiard or pool tables shall be the sum of $50.00 per table per calendar year payable on or before January 1st of each year, which sum shall be paid to the city clerk, who shall issue a receipt. In the event such fees are paid past the due date, a late fee of $25.00 shall be assessed and such business shall not thereafter be issued a license until such license fee and late fee are paid in full. The fees provided for herein are in addition to the license fee provided for in GMC 5.04.040. (Ord. 2008-27 § 2).

5.06.040 License fees – Bowling alleys.

Any person, firm or corporation intending to operate or maintain a bowling alley within the city shall pay a fee of $50.00 per calendar year payable on or before January 1st of each year, which sum shall be paid to the city clerk, who shall issue a receipt. In the event such fees are paid past the due date, a late fee of $25.00 shall be assessed and such business shall not thereafter be issued a license until such license fee and late fee are paid in full. The fees provided for herein are in addition to the license fee provided for in GMC 5.04.040. (Ord. 2008-27 § 2).

5.06.050 License – Assignment or transfer.

No license granted under the provisions of this chapter shall be assignable or shall authorize the operation or conducting of any establishment operating any billiard or pool table or bowling alley in any place or by any person other than specified in said license. (Ord. 2008-27 § 2).

5.06.060 Suspension or revocation – Appeal.

All licenses issued pursuant to this chapter may be suspended or revoked by the city clerk pursuant to GMC 5.04.110. (Ord. 2008-27 § 2).

5.06.070 Gambling prohibited – Closing hours.

A. It is unlawful for any person to bet, wager, or gamble upon the results of any game herein licensed to be played, or for the proprietor, or any other person in charge, of such billiard or pool room to allow betting, wagering or gambling upon the results of any game licensed to be played.

B. No billiard or pool room shall be open between the hours of 1:00 a.m. and 6:00 a.m. (Ord. 2008-27 § 2).

5.06.080 Violation – Penalties.

Any person who violates any of the provisions of this chapter shall be subject to the penalties provided in GMC 5.04.140. (Ord. 2008-27 § 2).
