5.16.010 Definitions.

For the purposes of this chapter, the words and phrases set forth in this section shall have the following meanings:

A. “Transient merchant” means any person who sells or offers to sell any goods, wares or merchandise within the city or operates any type of public entertainment such as a circus or carnival, or who is not permanently located and regularly taxed in the city and has no intention of permanently locating in the city.

B. “Carnival” shall mean a business activity featuring an assemblage of mechanical rides for the enjoyment, amusement, entertainment, merriment or pastime of the patrons thereof, and usually, but not necessarily, offers patrons in addition to the rides food and beverage services, as well as games involving throwing, pitching or shooting skills.

C. “Circus” shall mean any institution whose general occupation is that of exhibiting wild animals, feats of horsemanship, animal stunts and acrobatic or aquatic sports, to which a fee is charged for admission. (Ord. 2008-27 § 2).

5.16.020 Exemptions.

This chapter shall not apply to local churches, schools, societies or lodges or to persons or other organizations which are tax exempt under state or federal laws carrying on any such business or amusement described in GMC 5.16.010. (Ord. 2008-27 § 2).

5.16.030 License required.

It is unlawful for any transient merchant to conduct business within the city except as provided in GMC 5.04.010 without first obtaining a license from the city clerk and paying the license fees set forth in GMC 5.16.040. (Ord. 2008-27 § 2).

5.16.040 Fees.

The license fees for engaging in the activities described in this chapter shall be as follows:

A. Transient merchant, for each salesperson: $25.00 for three consecutive days;

B. Circus, carnival or show of any kind: $50.00 per day. (Ord. 2008-27 § 2).

5.16.050 Revocation of license.

Any license issued pursuant to this chapter may be revoked, in writing, by the city clerk for any of the following causes:

A. Any fraud, misrepresentation or false statement contained in the license application;

B. Any fraud, misrepresentation or false statement made in connection with the selling of products;

C. Any violation of this chapter;

D. Conviction of the licensee of any felony or of a misdemeanor involving moral turpitude;

E. Conducting the business licensed under this chapter in an unlawful manner or in such a manner as to constitute a breach of the peace or to constitute a menace to the health, safety or general welfare of the public; or

F. Any other reason set forth in GMC 5.04.110. (Ord. 2008-27 § 2).

5.16.060 Appeal.

Any person aggrieved by the denial of an application for a license or by the revocation of a license as provided for in this chapter shall have the right to appeal pursuant to the procedures set forth in Chapter 2.50 GMC. (Ord. 2008-27 § 2).

5.16.070 Violation – Penalty.

Any person who violates any of the provisions of this chapter shall be subject to the penalties provided in GMC 5.04.140. (Ord. 2008-27 § 2).
