9.36.010 Adoption.

9.36.030 Discharging firearms in city.

A. It is unlawful for any person to fire or discharge any pistol, gun or rifle or any firearm of any description or any air gun or bow and arrow within the city limits; provided, that persons duly authorized by the police chief may discharge said weapons in regular target practice when properly supervised and under permit of the chief of police and under such rules and regulations as the chief of police or the city council may from time to time specify, provided the provisions of this section shall not apply to property within the city limits, but which is controlled by the state; except, this section shall not apply to the discharging of any weapon described herein discharged in the lawful defense of persons or property as provided by state law.

B. Further provided that this chapter shall not apply to a person or persons operating under a permit from the police chief issued for the purposes of nuisance bird control. Said permit shall provide rules and regulations for the control of nuisance birds.

C. Violations of said nuisance bird permit shall constitute a violation of this chapter. (Ord. 2007-18 § 2).

9.36.040 Air gun – Defined.

As used in this chapter, the words “air gun” mean and include the following: air gun, air pistol, air rifle, BB gun and toy guns of any kind or nature when so designed, contrived, modified and used to propel by compressed air, gas or spring loaded plunger any pellet, dart, hard tipped arrow, bean, pea, BB, rock or other hard substance a distance of more than 25 feet with sufficient force to break windows or inflict injury upon persons or animals. (Ord. 2007-18 § 2).

9.36.050 Air guns – Sale or rent.

Except as provided in this chapter, it is unlawful for any merchant to sell or rent any air guns to minors under 18 years of age, except when such minor is in the presence of his parent or other adult in charge of such child. (Ord. 2007-18 § 2).

9.36.060 Air guns – Exceptions.

The provisions of GMC 9.36.030 shall not apply:

A. When any person is possessing or using such an air gun on a gun range operated or conducted by any school, educational institution or other regulated groups, pursuant to rules and regulations provided by the chief of police or city ordinance and licensed by the city; or

B. When using an air gun within a regulated or supervised course or range provided by the city parks department, under regulations or ordinances duly promulgated and adopted therefor; or

C. When any person is carrying an air gun unloaded and otherwise properly dismantled, to and from such licensed or authorized course. (Ord. 2007-18 § 2).

9.36.070 Air guns – Penalty for violation.

Any person convicted of a violation of the provisions of GMC 9.36.020 and 9.36.030 is guilty of a misdemeanor and, in addition to any other punishment imposed by the court, the court shall direct that the weapon so used in violation of the provisions thereof be confiscated. (Ord. 2007-18 § 2).

9.36.080 Police exempt from RCW 9.41.050(4).

The city of Grandview police officers are exempt from the prohibition on carrying a firearm found in RCW 9.41.050(4). (Ord. 2007-18 § 2).
