10.32.010 Definitions.

The following words and phrases when used in the chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them in this section:

A. “Bicycle” means and includes a light vehicle with two tandem wheels, with solid or pneumatic tires, having handlebars and a saddle seat or seats, and propelled by the feet acting on treadles connected to cranks or levers.

B. “Chief of police” means the chief of police of the city, or any member of the police department of the city, designated by the chief of police to act in his place and stead.

C. “Dealer in bicycles” means any person engaged in the sale of bicycles at retail or wholesale.

D. Gender. Wherever a word is used in the masculine gender in this chapter, it includes the feminine or neuter.

E. “Person” means any person, firm, copartnership, association or corporation.

F. “Rental agency” means any person engaged in the business of offering for rental and renting bicycles for use by the public.

G. “Roadway” means that portion of any alley, street or public highway between the regularly established curb lines, if any, or if there are no regularly established curb lines, then between the two outer edges thereof.

H. “Vehicle” means every device or animal by which any person or property is or may be transported upon a street, alley or public highway. (Ord. 2007-10 § 2).

10.32.080 Removal and stamping of frame numbers.

No person shall willfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this section; provided, that the chief of police may stamp numbers on the frames of bicycles on which no serial number can be found or on which the number is illegible or insufficient for identification purposes. 10.32.100 Riding restrictions.

A. Abreast – Single File. When two or more persons in a group are operating bicycles, they shall not ride abreast, but shall ride in single file.

B. Clinging to Vehicles. It is unlawful for any person operating a bicycle within the city to cling or attach himself or his bicycle to any other moving vehicle.

C. Emerging from Alleys, Driveways or Garages. The operator of a bicycle, emerging from an alley, driveway or garage, shall stop the bicycle immediately prior to driving onto or across a sidewalk or onto or across a sidewalk line, projected across an alley, and shall exercise extreme care in these cases.

D. Extra Passengers. It is unlawful for any person operating a bicycle within the city to carry another person on the same bicycle. This restriction shall not apply to tandem bicycles.

E. Riding While Intoxicated or Drugged. It is unlawful for any person to operate a bicycle within the city while under the influence of intoxicating liquor or drugs.

F. Lights. No bicycle shall be operated within the city between 30 minutes after sunset and 30 minutes before sunrise without a clear, white, properly lighted headlight, visible under normal atmospheric conditions from the front thereof, for not less than 200 feet, and firmly attached to the bicycle, or without a red reflector, firmly attached to the rear fender mudguard or seat of the bicycle, which is clearly visible in the headlight beam of an automobile for a distance of 200 feet to the rear of the bicycle.

G. Brakes. It is unlawful to operate a bicycle within the city unless the same is equipped with a proper, working and operating mechanical brake.

H. Keeping to the Right. All bicycles, when operated on roadways, shall be kept to the right and shall be operated as nearly as practicable at the right-hand edge of the roadway.

I. Speed. No bicycle shall be operated faster than is reasonable and proper, and every bicycle shall be operated with reasonable regard for the safety of the rider and of other persons and property.

J. Observation of Traffic Regulations. Every person operating a bicycle within the city shall observe all traffic signs and signals, and shall observe all other traffic rules and regulations applicable thereto.

K. Trick Riding. It is unlawful for any person operating a bicycle on the street or sidewalks of the city to guide a bicycle in any manner, except through the use of at least one hand upon the handlebars thereof, or otherwise to indulge in any kind of trick or unsafe riding.

L. Turns. The operator of a bicycle on a roadway, when making a right turn, shall follow the right-hand lane next to the right-hand edge of the roadway, and the operator of a bicycle on a roadway, when making a left turn, shall approach the point of turning in the traffic lane nearest the center of the roadway, and shall not cut the left-hand corner. No operator of a bicycle shall suddenly start, slow down, stop or attempt to turn without first giving the standard signal required by state law for motor vehicles under the same circumstances.

M. Parks. It is unlawful for any person to operate a bicycle within the parks of the city or on the sidewalk, or paths of such parks unless authorized by the Grandview parks and recreation director.

N. Sidewalks. It is unlawful to operate bicycles on the sidewalks of the city in the central business district. Bicycles may be operated on the sidewalks elsewhere than in the central business district; provided, that due care is at all times exercised by the rider. Under all circumstances, the rider shall yield the right-of-way to pedestrians using the sidewalks. (Ord. 2007-10 § 2).

10.32.110 Parking.

A. Business District. Bicycles, when parked in the business district, shall be parked only in those zones officially designated for that purpose by the commissioner of streets and public works and bicycles shall not, at any time or in any place, be indiscriminately parked by anyone along buildings in such a manner as to interfere with pedestrians, or along roadways where they may interfere with traffic or with persons getting into or out of automobiles. No person shall move, or in any manner interfere with, any bicycle which is properly parked, nor shall any person interfere with, or in any manner hinder, any person from properly parking a bicycle, except that members of the police department or fire department may move, or in proper cases prevent, the parking of a bicycle when, in the judgment of the policeman or fireman, his action is necessary in order properly to safeguard persons or property.

B. Supervision. The parking of said bicycles within the city shall at all times be under the direct regulation and supervision of the police department of the city. (Ord. 2007-10 § 2).

10.32.120 Impounding bicycle.

The chief of police is authorized and empowered to administer the provisions of this chapter. The chief of police is authorized and empowered to impound for a period of not to exceed 30 days any bicycle of any person who violates any of the provisions of this chapter, or of the ordinances of the city relating to street traffic, insofar as they are applicable. The action of the chief of police impounding a bicycle, as provided in this section, shall be conclusive and final. The impounding of a bicycle shall not preclude the infliction of any other penalties provided in this chapter upon the person whose bicycle is impounded. (Ord. 2007-10 § 2).

10.32.130 Violation – Penalty.

Any person who violates any of the provisions of this chapter shall have committed a civil infraction and shall be subject to a fine not to exceed $300.00. (Ord. 2007-10 § 2).
